BROWN COUNTY 

October 15, 2024 – GENERAL MEETING

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton and Wiese. Commissioner Fjeldheim led the Pledge of Allegiance.

MOMENT OF SILENCE: A Moment of Silence was held in remembrance of former U.S. Senator Tim Johnson.

APPROVAL OF AGENDA: Commissioner Wiese moved to approve the agenda, seconded by Gage.  All members present voting aye. Motion carried.

OPPORTUNITY FOR PUBLIC COMMENT: None

ORDINANCE #279 – FIRST READING: Moved by Commissioner Fjeldheim, seconded by Wiese to approve the First Reading of Proposed Ordinance #279. Applicant West Lake, LLC to rezone from Mini-Agriculture District (M-AG) to Highway Commercial District (HC) to bring these parcels into compliance for a future liquor and video lottery establishment: Lots 1 and 2 in the NE1/4 of Section 15-T123N-R64W, Except Highway R.O.W., of the 5th P.M., Brown County, South Dakota (2035 8th Avenue NW; Aberdeen Twp.). All members present voting aye. Motion carried.

ORDINANCE #280 – FIRST READING: Moved by Commissioner Dennert, seconded by Wiese to approve the First Reading of Proposed Ordinance #280. Applicant T.W., LLC to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring these parcels into compliance for their current use: Lot 1 and Lot 2, “Wollman Subdivision” in the SW1/4 of Section 29-T124N-R62W of the 5th P.M., Brown County, South Dakota (39504 129th Street & 12892 395th Avenue; Cambria Twp.). All members present voting aye. Motion carried.

ORDINANCE #281 – FIRST READING: Moved by Commissioner Gage, seconded by Dennert to approve the First Reading of Proposed Ordinance #281. Applicants Alan & Janet Dixon to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring these parcels into compliance for their current use: Proposed Lot 4, “Dixon Third Addition” in the NW1/4 of Section 15-T122N-R63W of the 5th P.M., Brown County, South Dakota (39135 138th Street, Gem Twp.). All members present voting aye. Motion carried.

ORDINANCE #282 – FIRST READING: Moved by Commissioner Wiese, seconded by Fjeldheim to approve the First Reading of Proposed Ordinance #282. Applicants are City of Aberdeen and New Angus, LLC to rezone from Heavy Industrial District (H-I) Municipal State and County Use District (M) as requested by the City of Aberdeen: Proposed Lot 2, “New Angus Second Subdivision” in the N1/2 of Section 36-T123N-R64W of the 5th P.M., Brown County, South Dakota (Approximately 498 135th Street SE; Aberdeen Township). All members present voting aye. Motion carried.

2025 FAIR BOARD APPOINTMENTS: Moved by Commissioner Fjeldheim, seconded by Wiese to approve the recommendations from the Fair Board an appointment the following for the 2025 Fair Board: New Members for their first 3-year terms – Joel Green, Ethan Sass, Dan Stevens and Alemita Shelton; Re-appoint for their second 3-year terms – Nichole Hacker, Katie Moulsoff and Joyce Voeller; Extended 1-year reappointment for Jayson Tollefson, Greg Markley and Shelly Eisenbeisz. All members present voting aye. Motion carried.

SURPLUS PROPERTY: Jon Lemke, Chief Deputy Sheriff submitted a request to declare the following Taser equipment surplus property in order to sell or transfer the items: 10-X26P Tasers; 16-X26P Cartridges; 11-X26P Holsters; 9-X26P Cartridge Holsters; 16-X2 Tasers; 127-X2 Cartridges; 15-X2 Holsters; 23-X2/X26P Batteries and 2-USB Data port Cables. Moved by Commissioner Wiese, seconded by Dennert to declare this equipment surplus and authorize the Sheriff’s Office to sell or transfer the items. All members present voting aye. Motion carried.

MINUTES: Moved by Commissioner Dennert, seconded by Gage to approve the General Meeting Minutes of October 8, 2024. All members present voting aye. Motion carried.

HR REPORT: Moved by Commissioner Dennert, seconded by Wiese to acknowledge and approve the following Human Resource Report submitted by Human Resources Director, Allison Tunheim:

  • Employment ending for Patricia Slutts, Brown County Jail Detention Officer, FT – effective October 7, 2024. Request to fill.
  • Resignation of Jennifer Gunckel, Brown County Jail Control Room, PT – effective October 1, 2024. Request to fill.
  • Adjusted effective date: Hiring of Alexis Kane, Brown County Jail Cook, FT – effective October 11, 2024.
  • Promotion of Jillian Klein from Brown County Appraisal Technician to Brown County Appraisal Assistant, starting wage $20.26/hour – effective October 13, 2024.
  • Reclassification of Deputy Director of Equalization from grade 19 to grade 20.
  • Job description, title and grade for Fair and Parks Assistant Manager to be placed at 19.
  • Job description, title and grade for Human Resources Generalist to be placed at 16 to include senior level incumbents being placed at grade 19.

TRAVEL REQUEST: Moved by Commissioner Gage, seconded by Wiese to approve the following travel requests: Dirk Rogers & Josh Mathews, Highway Dept. to travel to Ortonville, MN to look at a road widener on October 9, 2024. All members present voting aye. Motion carried.

CLAIM ASSIGNMENTS: Moved by Commissioner Dennert seconded by Wiese to approve and authorize Auditor Heupel to sign the Claim Assignments against individuals to Credit Collections Bureau for the purpose of collecting liens. All members present voting aye. Motion carried.

OTHER BUSINESS: Chairman Sutton shared that he was contacted by Rachel Kippley, Fair/Fairgrounds/Parks Manager about storing campers, boats and trailers in the infield. Looking at doing a flat fee of $200 for the season, since not being stored indoors wouldn’t charge by the foot. After some discussion, will need to include in the agreement that the County is not liable for any weather-related damages and that Rachel would include in her fees that are approved at the first meeting in January.
