BROWN COUNTY COMMISSION

October 22, 2024 – GENERAL MEETING

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton and Wiese. Commissioner Gage led the Pledge of Allegiance.

APPROVAL OF AGENDA: Commissioner Wiese moved to approve the agenda, seconded by Gage.  All members present voting aye. Motion carried.

OPPORTUNITY FOR PUBLIC COMMENT: Commissioner Wiese wanted to recognize Robin Bobzien, Aberdeen City Manager for his honor of being named the Outstanding City Manager of the Year since he was in attendance.

REQUEST FOR PROPOSAL (RFP) FOR INDIGENT COUNSEL:

Time and place, to open, read and consider request proposals from attorneys to provide legal services to fulfill Brown County’s statutory obligations as set forth in SDCL 23A-40-6 and 23A-40-7 and other such instances in which the appointment of legal counsel at the expense of the County has been mandated by statue. It is Brown County’s intent to enter into a one-year contract which will commence on January 1, 2025. No proposals were received. Chairman Sutton stated that we are in the process of setting up a Public Defender’s Office, applications are due on Friday, then the Committee that was formed with meet with those people, so we will see how it turns out.

APPLICATION FOR OCCUPANCY FOR NORTHWESTERN ENERGY: Moved by Commissioner Wiese, seconded by Dennert to approve the following application submitted by NorthWestern Energy for occupancy of Brown County Highway #13, in Section 23-T124-R65 Brown County, South Dakota for gas line under the road to increase pressure to North side of Richmond Lake. All members present voting aye. Motion carried.

APPLICATION FOR OCCUPANCY FOR ARLEN MCNEIL: Moved by Commissioner Dennert, seconded by Fjeldheim to approve the following application submitted by Arlen McNeil  for occupancy of Brown County Highway #23, in Section 4, T121-R62 Brown County, South Dakota for inlet for Drain Tile. All members present voting aye. Motion carried.

APPLICATIONS FOR OCCUPANCY FOR NORTHERN ELECTRIC: Moved by Commissioner Wiese seconded by Fjeldheim to approve the following applications submitted by Northern Electric for occupancy of Brown County Highway #12W in Section 18-T123N-R64W Brown County, South Dakota for primary electrical and Brown County Highway #13 in Section 6-T123N-R63W Brown County, South Dakota for primary electrical. All members present voting aye. Motion carried.

MINUTES: Moved by Commissioner Wiese, seconded by Gage to approve the General Meeting Minutes of October 15, 2024. All members present voting aye. Motion carried.

HR REPORT: Moved by Commissioner Wiese, seconded by Dennert to acknowledge and approve the following Human Resource Report submitted by Human Resources Director, Allison Tunheim:

  • Resignation of Tina Jacobs, Brown County Jail Detention Officer; PT – effective October 14, 2024. Request to fill.
  • Last day for seasonal worker, Nancy Radke, Brown County Fairgrounds; effective October 2, 2024.
  • Return of John Weig as Brown County Fairgrounds worker, seasonal temporary from October 15, 2024 to October 18, 2024; wage $15.50/hr.
  • Governor granted State Holiday off: Monday, December 23, 2024.

TRAVEL REQUEST: Moved by Commissioner Wiese, seconded by Gage to approve the following travel requests: Rachel Kippley & McKenzie Bierman, Fair Dept. to travel to Rapid City, SD for the Rocky Mountain Assoc. of Fairs Convention on November 13-16, 2024; Dirk Rogers, John Florey & Josh Mathews, Highway Dept. to travel to Sioux Falls, SD for the Local Roads Conference on October 21-23, 2024. All members present voting aye. Motion carried.

CLAIM ASSIGNMENTS: Moved by Commissioner Dennert seconded by Wiese to approve and authorize Auditor Heupel to sign the Claim Assignments against individuals to Credit Collections Bureau for the purpose of collecting liens. All members present voting aye. Motion carried.

ZONING ORDINANCE – SET HEARING DATE/AUTHORIZE ADVERTISING: Moved by Commissioner Wiese, seconded by Gage to set hearing date and authorize publication for the first reading of the following zoning ordinance to be held on November 12, 2024 in the Commission Chambers, Courthouse Annex, Brown County, South Dakota. Proposed Ordinance #283, applicant Larkota Acres – Briann & Lisa Larson for the purpose of rezoning the following property from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring these parcels into compliance for their current use: Description of property: Proposed Lots 1 thru 12, “Larkota First Addition” in the N1/2 of the SW1/4 of Section 3-T121N-R64W of the 5th P.M., Brown County, South Dakota (38504, 38507, 38512, 38515 & 38518, 38523, 38526, 38529, 38532, 38535, 38538 & 38541 Larkota Drive; Warner Twp.). PRAIRIE’S EDGE SIXTEENTH ADDITION PLAT:

Commissioner Gage brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing Prairie’s Edge Sixteenth Addition in the NW ¼ of Section 8-T123N-R63W of the 5TH P.M., Brown County, South Dakota , having been examined, is hereby approved in accordance with the provision of SDCL 11-3, and any amendments thereof”. Seconded by Dennert. All members present voting aye. Resolution adopted.

LARKOTA ACRES FIRST ADDITION PLAT:

RESOLUTION #56-24

Commissioner Wiese brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing Larkota Acres First Addition in the N ½ SW ¼ of Section 3-T121N-R64W of the 5TH P.M., Brown County, South Dakota , having been examined, is hereby approved in accordance with the provision of SDCL 11-3, and any amendments thereof”. Seconded by Fjeldheim. All members present voting aye. Resolution adopted.

SC KRUEGER ADDITION PLAT:

RESOLUTION #57-24

Commissioner Wiese brought the following resolution “Be it resolved by the Board of County Commission of Brown County, South Dakota that the plat showing SC Krueger Addition in the W ½ of Section 13-Township 121 North, Range 61 West of the 5TH P.M., Brown County, South Dakota , having been examined, is hereby approved in accordance with the provision of SDCL of 1967, Chapter 11-3, and any amendments thereof”. Seconded by Gage All members present voting aye. Resolution adopted.

JEREMY JOHNSON ADDITION TO COLUMBIA PLAT:

RESOLUTION #58-24

It was moved by Commissioner Fjeldheim and seconded by Dennert and motion carried, that the plat as shown hereon and as described on the accompanying plat of “Jeremy Johnson Addition to Columbia”, in the NE ¼ of Section 29, Township 125 North, Range 62 West of the 5TH P.M., in Brown County, South Dakota, be approved and accepted and the County Auditor is hereby instructed to endorse on such plat a copy of this resolution and to certify the same. Resolution adopted.

COLUMBIA 20S OUTLOT PLAT:

RESOLUTION #59-24

Commissioner Wiese brought the following resolution “Be it resolved by the County Commission of Brown County, South Dakota, that the plat showing “Columbia 20S Outlot to the City of Columbia in the S ½ SE ¼ of Section 20, Township 125 North, Range 62 West of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provision of SDCL of 1967, Chapter 11-3, and any amendments thereof”. Seconded by Fjeldheim. All members present voting aye. Resolution adopted.

KNECHT FIRST ADDITION TO HOUGHTON PLAT:

RESOLUTION #60-24

Commissioner Gage brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing Knecht First Addition to Houghton in the NE ¼ of Section 6-T126N-R61Wof the 5TH P.M., Brown County, South Dakota , having been examined, is hereby approved in accordance with the provision of SDCL 11-3, and any amendments thereof”. Seconded by Dennert. All members present voting aye. Resolution adopted.

MOPAR FIRST ADDITION PLAT:

RESOLUTION #61-24

Commissioner Dennert brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing Mopar First Addition in the N ½ NW ¼ of Section 17-T124N-R62W of the 5TH P.M., Brown County, South Dakota , having been examined, is hereby approved in accordance with the provision of SDCL 11-3, and any amendments thereof”. Seconded by Wiese. All members present voting aye. Resolution adopted.

NEW ANGUS SECOND SUBDIVISION PLAT:

RESOLUTION #62-24

Commissioner Wiese brought the following resolution “Be it resolved by the County Commission of Brown County, South Dakota, that the plat showing “New Angus Second Subdivision in the N1/2 of Section 36, Township 123 North, Range 64 West of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provision of SDCL of 1967, Chapter 11-3, and any amendments thereof”. Seconded by Fjeldheim. All members present voting aye. Resolution adopted.

OTHER BUSINESS: Senator Elect, Carl Perry shared the following awards given out by the Aberdeen Exchange Club: Young Citizen Awards – Gianna Cihak & Ericka Dix from Aberdeen Roncalli; Alainna Flannigan & Jaden Voehl from Holgate; Brandon Sieh & Hattie Buckmeier from Simmons and Carter Ingemansen from Aberdeen Christian; Youth of the Month Awards went to Felipe Gonzales from Aberdeen Central; Ava Hanson from Aberdeen Roncalli and Alicia Davis from Aberdeen Christian.

EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Gage to go into Executive Session for Personnel per SDCL 1-25-2. All members present voting aye. Motion carried. The chair declared the executive session closed with no action taken.

ADJOURNMENT: Moved by Commissioner Fjeldheim, seconded by Wiese to adjourn the Brown County Commission at 9:50 a.m. All members present voting aye. Motion carried.
