December 31, 2024 – GENERAL MEETING
Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton and Wiese. Commissioner Fjeldheim led the Pledge of Allegiance.
APPROVAL OF AGENDA: Moved by Commissioner Wiese to approve the agenda with the addition of adding Surfacing Project Bid Opening, seconded by Gage. All members present voting aye. Motion carried.
OPPORTUNITY FOR PUBLIC COMMENT: Kent Jones, Communication Director Thanked Commissioner Doug Fjeldheim for his years served on the Communications Council and Brown County Commission.
Jordan McQuillen, Aberdeen City Finance Officer met with the Commission to update them that TIF 18 – Arbor Springs was dissolved at the December 24, 2024 City Council meeting.
Dennis Feickert shared with the Commission that McPherson County has passed a moratorium on Data Centers and believes that Spink County will be doing one as well. Wanted to bring that their attention and shared that he had met with Robin Bobzien, City of Aberdeen Manager regarding the Pipeline map from Groton to Aberdeen. Dennis believes that Mayor Schaunaman may do a possible intervention. Dennis also informed the Commission of a Rally to be held in Pierre on January 13th and then January 17th there will be a PUC meeting at the DEC. Then Dennis finished by also thanking Commissioner Doug Fjeldheim for his years of service.
ORDINANCE #284 – SECOND READING/POSSIBLE ADOPTION: Moved by Commissioner Fjeldheim, seconded by Wiese to adopt Ordinance #284. Applicant Pat & Donna Keatts to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring these parcels into compliance for their current use: Description of property: Proposed Lots 1 & 2, “Keatts Eighth Subdivision to Richmond Lake” in the W1/2 of Section 23-T124N-R65W of the 5th P.M., Brown County, South Dakota (12704 & 12705 Camdon Court, Ravinia Twp.). VACATE A PLAT: REECE TREEBY ADDITION: A public hearing was held on a Petition to Vacate a Plat submitted by Treeby, LLC; Hal Treeby, Member pursuant to SDCL 11-3. The legal description of the plat: Lot 1, “Reece Treeby Addition” in the NW ¼ of Section 15-T128N-R61W of the 5TH P.M., Brown County, South Dakota. VACATE A PLAT: OLE CROW ADDITION: A public hearing was held on a Petition to Vacate a Plat submitted by Stacy Gossman pursuant to SDCL 11-3. The legal description of the plat: Proposed Former Lot 1, “Ole Crow Addition” in the NW ¼ of Section 17-T123N-R63W of the 5TH P.M., Brown County, South Dakota (765 Ole Crow Lane, Aberdeen Twp.) Commissioner Wiese ask to postpone action on vacating this plat because he would like to have the dedicated R-O-W be separated and remain for future development. Stacy Gossman would like to have the property go back to the way it was. Moved by Commissioner Wiese, seconded by Dennert to postpone action on vacating this plat and to get together with Stacy Gossman to work out the R-O-W. All members present voting aye. Motion carried.
PUBLIC HEARING – ALCOHOLIC BEVERAGE TEMPORARY PERMIT FOR SPECIAL EVENT: Moved by Commissioner Wiese, seconded by Gage to approve the following Alcoholic Beverage Temporary Permit in conjunction with a Special Event for Malt Beverage and Wine License to Aberdeen Area Chamber of Commerce, Aberdeen, SD for Business After Hours: Lt 2 SDWG Bath – Grebner Terminal Add (Lt A 1st Repl SDWG Add S2 14-123-63) (39278 133rd St., Aberdeen) Brown County, SD; effective January 9, 2025. 2025 BRIDGE IMPROVEMENT GRANT (BIG) APPLICATION: Moved by Commissioner Wiese, seconded by Fjeldheim to approve and authorize Chairman Sutton to sign 2025 BIG Application for Sand Lake Bridge (Structure Number 07-200-184 & Location: 4 miles north of Columbia, SD) for SD Dept. of Transportation. All members present voting aye. Motion carried.
UTILITIES CERTIFICATE FOR BIG PROGRAM: Moved by Commissioner Wiese, seconded by Dennert to approve and authorize Chairman Sutton to sign Utilities Certificate for the BIG Project number #BRF 6251(00)##-# with James Valley Telecommunications and Web Water Development. BID OPENING – SURFACING PROJECT BIDS: Time and place, as advertised to open, read and consider sealed bids for 2025 Brown County Surfacing Project which includes the following work: 2 “ Asphalt Concrete overlay for approximately 21 miles and additional items as set forth in the Contract Documents. Dirk Rogers, Highway Superintendent and Mike Gutenkauf, IMEG opened the following bids: Bituminous Paving, Inc. from Ortonville, MN for $4,209,610.00; Lien Transportation from Aberdeen, SD for $4,612,794.80; Anderson Western, Inc. from Bismarck, ND for $5,114,792.04; Central Specialties, Inc. from Alexandria, MN for $4,532,796.37; Duininck, Inc. from Prinsburg, MN for $4,712,387.57 and Border States Paving, Inc. from Fargo, ND for $4,865,929.70. Dirk asked to defer awarding the bid so Mike could review the numbers. Commissioner Wiese moved to defer the bid award, seconded by Gage so that Mike with IMEG could review the numbers before granting the bid. All members present voting aye. Motion carried.
INDIGIENT COUNSEL CONTRACT: Chairman Sutton shared that the County is continuing to move forward and have a Public Defenders office and will be taking applications through January 2025. Ross Aldentaler, States Attorney Deputy shared that they had a meeting with the judges and an attorney from the contract and it was suggested to reject the proposal and go back to voucher system until we get Public Defenders office going because it will be hard to transition from the contracts. Per recommendation, Commissioner Wiese moved to reject the Indigent Counsel Contract, seconded by Gage. All members present voting aye. Motion carried.
SOLID WASTE (SW) MANAGEMENT APPLICATION FOR LANDFILL COMPACTOR: Moved by Commissioner Wiese, seconded by Dennert to approve & authorize Chairman Sutton to sign the application for the SW Management Landfill Compactor. All members present voting aye. Motion carried.

A RESOLUTION TO APPOINT COUNTY CORONER
WHEREAS, following the notice of resignation of the duly appointed Coroner of Brown County the Brown County Commission has determined that the Retired Brown County Sheriff’s Deputy Brian Koens would be appropriately qualified to carry out the duties of the Brown County Coroner.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Brown County Commissioners does hereby appoint Retired Brown County Sheriff’s Deputy Brian Koens to serve as Brown County Coroner at the pleasure of the board and until such time that the appointment be modified or rescinded by further resolution.

SWEARING IN: Auditor Heupel swore Brian Koens in as Brown County Coroner.
DACOTAH PRAIRIE MUSEUM EXPANSION: A Resolution was presented for approval of the Dacotah Prairie Museum Expansion into the North Parking Lot. Commissioner Sutton shared that he had been contacted with concerns about the parking space, but he supports the renovation of the Museum. After further discussion, Commissioner Dennert moved to postpone passing a resolution at this time and asked Patricia Kendall, Museum Director to come back with a plan B or options for parking, seconded by Gage. Motion passed 4 to 1 with Wiese voting No.
AWARDING OF BID: Dirk Rogers, Highway Superintendent returned with a recommendation to accept the bid from Bituminous Paving, Inc. from Ortonville, MN. Moved by Commissioner Fjeldheim to award the Surfacing Project Bid to Bituminous Paving, Inc. for $4,209,610.00, seconded by Dennert. All members present voting aye. Motion carried.
DEPARTMENT UPDATE: Commissioner Fjeldheim asked for an update on the Guard Rail at Richmond Lake. Dirk informed Commission that it has been awarded but the work won’t start until Spring. Senator Elect, Perry shared the Governor did approve $13 million in the State Budget for the Richmond project as well.
SOUTH DAKOTA COMMUNITY HEALTH SERVICES AGREEMENT FOR 2025: Moved by Commissioner Wiese, seconded by Fjeldheim to approve and authorize Chairman Sutton to sign the 2025 Agreement with South Dakota Community Health Services. All members present voting aye. Motion carried.
JOINT COOPERATIVE AGREEMENT (JCA) WITH NECOG: Moved by Commissioner Fjeldheim, seconded by Wiese to approve & authorize Chairman Sutton to sign the JCA with NECOG for 2025. All members present voting aye. Motion carried.
LEASE AGREEMENT FOR BROWN COUNTY RACEWAY: Moved by Commissioner Wiese, seconded by Gage to approve and authorize Chairman Sutton to the sign the Lease Agreement for the Brown County Raceway with Motor Sports, LLC from April 1 to October 31, 2025 with options to renew the lease for four additional one-year periods at the sole discretion of the County. All members present voting aye. Motion carried.

ASSIGN BUGET BALANCE REQUESTS: Auditor Heupel shared that Judy Dosch, Building Superintendent asked that her budget balance of $600,689.65 be assigned to Maintenance for the continuing work needing to be done for the Tuckpointing project. Moved by Commissioner Dennert, seconded by Fjeldheim to approve assigning the budget balance of $600,689.65 to maintenance. All members present voting aye. Motion carried.
Becca Tullar, 4-H Advisor had submitted a memo requesting that her budget balance of $8,721.89 be assigned to the new building project at the Fairgrounds. After some discussion it was moved by Commissioner Wiese, seconded by Fjeldheim to not approve this request and the funds go back to the General Fund. All members present voting aye. Motion carried. Commissioner Sutton shared that during the next budget session, the Commission will look at assigning funds towards the building project.
Fair/Fairgrounds Manager Rachel Kippley had asked the Commission to $651,509 into the Fair Improvement fund but Commissioner Sutton had asked for this to be postponed seeing what the Auditor had for final numbers. It was shown that the Fair had a net gain of $380,754.55 for 2024. Commissioner Wiese moved by assign $350,000.00 to the Fair Improvement fund, seconded by Sutton. After further discussion, Commissioner Dennert moved to assign the total $380,754.55 to the Fair Improvement Fund, seconded by Wiese. All members present voting aye. Motion carried.

OTHER BUSINESS: Senator Elect, Carl Perry shared that the Brown County Republicans luncheon will be held on January 9th and all County Officials are to attend and give a brief update.
EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Gage to go into Executive Session for Personnel and Legal per SDCL 1-25-2. All members present voting aye. Motion carried. The chair declared the Executive Session closed with No Action Taken.
THANK-YOU: Commissioner Doug Fjeldheim took a moment to Thank his fellow and former Commissioners, along with Department Heads, Elected Officials and employees of Brown County for doing the best job possible under restricted budgets every year and would like to Thank the citizens of Brown County for supporting him for the last 10 years.
Commissioner Sutton thanked Doug for his 10-years of dedication to the citizens of Brown County and stated it was a privilege serving with him as well.
