BROWN COUNTY COMMISSION
JULY 16, 2024 – GENERAL MEETING
Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton, and Wiese. Commissioner Dennert led the Pledge of Allegiance.
APPROVAL OF AGENDA: Moved by Commissioner Wiese to approve the agenda, seconded by Dennert. All members present voting aye. Motion carried.
OPPORTUNITY FOR PUBLIC COMMENT: Scott Vincent, Director of Logistics for Strobel Energy Group/Strobel Logistics met with the Commission to inform them what their plans are regarding hauling tallow to Claremont from the Beef Processing Plant and loading into the rail cars. There will be 4 trucks a day and it takes about 30 minutes to unload into the railcar; estimating roughly filling one railcar per day. Mr. Vincent shared the tallow is going to be shipped once a week to the west coast and be used for Renewable Diesel. He also shared they met with the Claremont Community, who asked them to find a different route in and out of town, so they are looking into that; Mr. Vincent shared he has visited with Dirk Rogers, County Highway Superintendent, also on this matter.
ORDINANCE #273 – FIRST READING: Moved by Commissioner Fjeldheim, seconded by Wiese to approve the First Reading of Proposed Ordinance #273. Applicant Arlene Webb to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its current use: Proposed Lot 1, “Beving-Webb Addition” in the SE1/4 of Section 13-T123N-R65W of the 5th P.M., Brown County, South Dakota (13291 382nd Avenue; Mercier Twp.). All members present voting aye. Motion carried.
ORDINANCE #274 – FIRST READING: Moved by Commissioner Gage, seconded by Wiese to approve the First Reading of Proposed Ordinance #274. Applicants TC Wright Trust/Dennis Jones/Chad & Jean Ferguson to rezone 3 parcels from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) and 1 parcel from Mini-Agriculture District (M-AG) to Agriculture Preservation District (AG-P) to bring these parcels into compliance for their current use: Lot 1 & 2, “Wright Third Subdivision” in the NE1/4 of Section 7-T123N-R62W and Lot 1 & 2, “Jones-Wright Addition” in the E1/2 of Section-T123N-R62W, all of the 5th P.M., Brown County, South Dakota (13121, 13145, 13149, 13153 395th Avenue, Bath Twp.). APPLICATIONS FOR OCCUPANCY: Moved by Commissioner Wiese, seconded by Fjeldheim to approve the following application submitted by Northern Electric for occupancy of Brown County Highway #14 in NW ¼ of Section 21-T126N-R63W Brown County, South Dakota for primary electric cable. All members present voting aye. Motion carried.
Moved by Commissioner Dennert, seconded by Wiese to approve the following application submitted by Northwestern Energy for occupancy of Brown County Highway #14 in Section 36-T123N-R63W Brown County, South Dakota to install 35 kv URD cable. All members present voting aye. Motion carried.
HIGHWAY DEPARTMENT UPDATE: Dirk Rogers, Highway Superintendent gave the Commissioners a Department Update. Dirk shared that they should finish the grade raise at Frederick this week; Micro-surfacing is done except the striping and Monday they will begin paving projects. He shared there are sensors that are measuring the water pressure at Richmond Lake to gather information for the Richmond Spillway project.
ALCOHOLIC BEVERAGE TEMPORARY PERMITS FOR SPECIAL EVENTS: Moved by Commissioner Wiese, seconded by Gage to approve the following Alcoholic Beverage Temporary Permit for Special Event to Stacy Gossman, DBA: Flying Pig (RL-5733) at the Brown County Fairgrounds Clubhouse for 3M 50th Anniversary Event on September 14, 2024. All members present voting aye. Motion carried.
Moved by Commissioner Wiese, seconded by Fjeldheim to approve the following Alcoholic Beverage Temporary Permit for Special Event to Stacy Gossman, DBA: Nacho Business (RL-26086) at the Brown County Fairgrounds Clubhouse for a wedding on September 21, 2024. All members present voting aye. Motion carried.
DISCUSS RFP FOR COURT APPOINTED ATTORNEYS (INDIGENT COUNSEL): Karly Winters met with the Commission regarding the RFP received for Court Appointed/Indigent Counsel. Chairman Sutton shared that this is still ongoing process and nothing to present at this time but will decide in the next couple of weeks.

TRAVEL REQUESTS: Move by Commissioner Dennert, seconded by Wiese to approve the following Travel Request: Lynn Heupel, Auditor; Stephanie Jacobson, Elections Coordinator; Pat Wolberg, IT Director and 1 Employee from the Sheriff’s Department to attend Tabletop the Vote 2024 on August 26, 2024 in Pierre, SD. All members present voting aye. Motion carried.
TEMPORARY SPECIAL EVENT ALCOHOL LICENSE PERMIT HEARING: Moved by Commissioner Wiese, seconded by Gage to authorize advertising public hearing for the following Special Alcohol License Permit: Boys & Girls Club of Aberdeen Area, Aberdeen, SD – Brown County Fair Grandstand – SW ¼ of Sec 1-T123N-R64W Brown County, SD on August 6, 2024. (Special License effective August 12-18, 2024). All members present voting aye. Motion carried.
LOCAL EMERGENCY MANAGEMENT PERFORMANCE GRANT (LEMPG): Moved by Commissioner Dennert, seconded by Wiese to approve and authorize Chairman Sutton to sign the 3rd Quarter Report for LEMPG Grant. All members present voting aye. Motion carried.
ACKNOWLEDGE RESIGNATION OF BROWN COUNTY FAIR BOARD MEMBER: Moved by Commissioner Fjeldheim, seconded by Wiese to acknowledge the resignation of Brown County Fair Board Member, Lee Koch due to moving out of the County. All members present voting aye. Motion carried. Commissioners expressed their ‘Thanks’ for his many years of service to the Fair Board.
OTHER BUSINESS: Kyler Dinger informed the Commission that he was contacted by a constituent due to having gotten 3 flat ties by the South Dumpsite. Chairman Sutton said he would contact the Landfill and Highway Superintendents to look into this matter.
EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Fjeldheim to go into Executive Session for Personnel, Contracts and Legal per SDCL 1-25-2. All members present voting aye. Motion carried. The chair declared the executive session closed with no action taken.
Chairman Sutton shared they just received notice that Milton Ustad, former Union County Commissioner passed away on Saturday, July 13th. Condolences to his family were expressed.
