BROWN COUNTY COMMISSION

SEPTEMBER 24, 2024 – GENERAL MEETING

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton, and Wiese. Commissioner Fjeldheim led the Pledge of Allegiance.

APPROVAL OF AGENDA: Chairman Sutton shared that he was informed to remove the ‘Purchase of a Pickup” from the agenda for the Landfill. Commissioner Wiese moved to approve the agenda as amended, seconded by Gage.  All members present voting aye. Motion carried.

OPPORTUNITY FOR PUBLIC COMMENT: None

2025 ANNUAL BUDGET: Commissioner Wiese offered the following Resolution:

ANNUAL BUDGET FOR BROWN COUNTY, SD

For the Year January 1, 2025 to December 31, 2025

RESOLUTION #48-24

ADOPTION OF ANNUAL BUDGET FOR BROWN COUNTY, SOUTH DAKOTA

Whereas, (7-21-5 thru 13), SDCL provides that the Board of County Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues of the County and all its institutions and agencies for such fiscal year and,

Whereas, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and

Whereas, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, eliminations and additions have been made thereto.

NOW THEREFORE, BE IT RESOLVED, That such provisional budget as amended and all its purposes, schedules, appropriations, amounts, estimates and all matters therein set forth, SHALL BE APPROVED AND ADOPTED AS THE ANNUAL BUDGET OF THE APPROPRIATION AND EXPENDITURES FOR BROWN COUNTY, SOUTH DAKOTA and all its institutions and agencies for calendar year beginning January 1, 2025 and ending December 31, 2025 and the same is hereby approved and adopted by the Board of County Commissioners of Brown County, South Dakota, this 24th day of September, 2024.  The Annual Budget so adopted is available for public inspection during normal business hours at the office of the County Auditor, Brown County, South Dakota.  The accompanying taxes are levied by Brown County for the year January 1, 2025, through December 31, 2025.

ORDINANCE #276 – FIRST READING: Moved by Commissioner Wiese, seconded by Dennert to approve the First Reading of Proposed Ordinance #276. Applicant Jeffery Walth to rezone from Heavy Industrial District (H-I) to Highway Commercial District (HC) to bring this parcel into compliance for its current use: Proposed Outlot 2, “Aberdeen Twp 20W Outlots” in the E 1/2 of Section 20-T123N-R64W of the 5th P.M., Brown County, South Dakota (38380 W Hwy 12, Aberdeen Twp.). All members present voting aye. Motion carried.

ORDINANCE #277 – FIRST READING: Moved by Commissioner Fjeldheim, seconded by Wiese to approve the First Reading of Proposed Ordinance #277. Applicant Amy & Joshua Gulstad to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its current and future use: Description of property: “Olson’s Outlot A” in the NW1/4 of Section 25-T126N-R64W of the 5th P.M., Brown County, South Dakota (11646 387th Avenue, Oneota Twp.). All members present voting aye. Motion carried.

ORDINANCE #278 – FIRST READING: Moved by Commissioner Dennert, seconded by Wiese to approve the First Reading of Proposed Ordinance #278. Applicant Jacki Holler – S & P Holdings, LLC to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its current use: Description of property: Lot 1, “Johnson South Third Subdivision” in the NE1/4 of Section 22-T122N-R64W of the 5th P.M., Brown County, South Dakota (13919 386th Avenue, Warner Twp.). All members present voting aye. Motion carried.

SOLID WASTE TIPPING FEE SCHEDULE – 2025:Commissioner Wiese offered the following Resolution:

RESOLUTION #49-24

WHEREAS, Title 3, Solid Waste Management System, Chapter 3.07010 of the Second Revision Brown County Ordinances, effective March 12, 1997, as amended, requires the Board of County Commissioners to establish the fees for use of the landfill.

NOW, THEREFORE BE IT RESOLVED, that the following Solid Waste Tipping Fee Schedule shall be effective January 1, 2025:

LANDFILL PERMIT RENEWAL: Mike Scott, Landfill Manager and Leif Redinger from Helms Engineering met with the Commission to get approval and authorize Chairman Sutton to sign the Landfill Permit Renewal application to operate a Solid Waste Disposal Facility, which will be sent to the State for approval. Moved by Commissioner Wiese and seconded by Dennert to approve and authorize Chairman Sutton to sign the Landfill Permit Renewal Application to operate a Solid Waste Disposal Facility. All members present voting aye. Motion carried.

REQUEST FOR PROPOSALS FOR GRANDSTANDS: Rachel Kippley, Fair/Fairgrounds/Parks manager met with Commission and informed them the contract for the racetrack is up, so they want to ask for Bids to provide Races or Other Entertainment; to see if there any other venues that may be interested in hosting events at the Grandstands for 2025-2029. Moved by Commissioner Dennert, seconded by Wiese to approve advertising for Bids for the Grandstands for 2025-2029. All members present voting aye. Motion carried.

REQUEST FUNDS FROM OPIOID SETTLEMENTS: Justin Scott,  President of the Brown County Treatment Court Association met with the Commission and asked if they would give $25,000.00 of the Opioid Settlement funds. The Association has applied for 501 (c) status, and they are asking for these funds to help those in Drug & DUI Court Program, which is an alternate route for substance abuse. The money would help pay for their necessities, graduation to complete the program; they are partially funded by the State and get assistance for Mental Health services, also. Moved by Commissioner Wiese, seconded by Fjeldheim to approve giving $25,000.00 to the Brown County Treatment Court Association. The motion passed with 4 votes; Commissioner Gage abstained due to having relation that works with the Drug Court Program.

QUOTES FOR 124 BUILDING DOWN SPOUTS: Randy Zens, Assistant Building Superintendent presented the Commission with two quotes to fix the down spout issue at the 124 Building that causes ice buildup in the parking lot, creating a safety hazard. Aberdeen Contracting, LLC quote is $16,326.56 and Dahme Construction quote is $65,270.67. The only difference being that Aberdeen Contracting plans to use 8” storm sewer piping and Dahme plans to use 12” storm sewer piping; so, they recommend going with Aberdeen Contracting, LLC. Moved by Commissioner Dennert, seconded by Wiese to accept the quote from Aberdeen Contracting, LLC for $16,326.56 to fix the down spout issue at the 124 Building. All members present voting aye. Motion carried.

CHANGE ORDER FOR RESTORATION PROJECT: Judy Dosch, Building Superintendent met with the Commission to present them with a Change Order on the Tuckpoint Project in the amount of $66,281.00 due to needing to replace and flash double lintel on the Maintenance Garage. Moved by Commissioner Wiese, seconded by Fjeldheim to approve and authorize Chairman Sutton to the sign the Change Order for the Building Restoration/Tuckpointing project in the amount of $66,281.00. All members present voting aye. Motion carried.

Judy also informed the Commission that they will not be able to complete the Tuckpointing project on the Dome this year because not able to get scaffolding in place to work on it. They are going to need to make 16 openings in the roof and attach poles to the structural under the roof, in order to get the scaffolding in place. The cost for steel suppliers, the roofers and metal installation of the 16 openings is $113,674.00; does not include structural engineers. They may need to get IMEG in for engineering purposes; there are large steel beams and panels in place but there are clay tiles with cement that she doesn’t want damaged; or crushing the duct work and not coming through the ceiling. Moved by Commissioner Wiese, seconded by Gage to approve the extension of the project and the estimated cost of $113,674.00 at this time. All members present voting aye. Motion carried.

APPLICATIONS FOR OCCUPANCY FOR NORTHERN VALLEY COMMUNICATIONS (NVC): Moved by Commissioner Fjeldheim, seconded by Wiese to approve the following applications submitted by NVC for occupancy of Brown County Highway #14E in Section 16,23-T123-R63 Brown County, South Dakota for boring and plowing to replace fiber optic that is not working; Brown County Highway #20 in Section 10-T124-R60 Brown County, South Dakota for boring and plowing to install broadband. All members present voting aye. Motion carried.

APPROVE CAFETERIA PLAN & AUTHORIZE HR DIRECTOR TO SIGN DOCUMENTS: Moved by Commissioner Gage, seconded by Wiese to approve the Cafeteria Plan and authorize Allison Tunheim, HR Director to sign the documents on behalf of the County. All members present voting aye. Motion carried.

APPROVE USING PUBLIC PURCHASE & PUBLIC SURPLUS: Auditor Heupel informed the Commission that these services are at no cost to the County; they earn their money through the Buyer Premiums, and this would increase or widened our exposure as well. Moved by Commissioner Wiese, seconded by Dennert to approve using Public Purchase & Public Surplus for Bids, Surplus Auctions, etc. All members present voting aye. Motion carried.

CLAIM ASSIGNMENTS: Moved by Commissioner Gage, seconded by Dennert to approve and authorize Auditor Heupel to sign the Claim Assignments against individuals to Credit Collections Bureau for the purpose of collecting liens. All members present voting aye. Motion carried.

ZONING ORDINANCES – SET HEARING DATE & AUTHORIZE ADVERTISING: Moved by Commissioner Gage, seconded by Wiese to set hearing date and authorize publication for the first reading of the following zoning ordinance to be held on October 15, 2024 in the Commission Chambers, Courthouse Annex. Brown County, South Dakota. Seconded by Wiese. All members present voting aye. Resolution adopted.

Commissioner Wiese brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing Donald Raba and WW Rentals First Addition to the City of Columbia, in the SW ¼  of Section 28-T125N-R62W of the 5TH P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof”. Seconded by Dennert. All members present voting aye. Resolution adopted.

Commissioner Fjeldheim brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing OALC Second Subdivision in the SE ¼  of Section 34-T124N-R64W of the 5TH P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof”. Seconded by Wiese. All members present voting aye. Resolution adopted.

DIXON THIRD ADDITION PLAT:

RESOLUTION #53-24

Commissioner Wiese brought the following resolution “Be it resolved by the County Commission of Brown County, South Dakota that the plat showing Dixon Third Addition in the NW ¼  of Section 15-T122N-R63W of the 5TH P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof”. Seconded by Gage. All members present voting aye. Resolution adopted.

OTHER BUSINESS: Carl Perry, Senator Elect for District 3 shared that the Exchange Club gave out some Young Citizenship Awards to the following students: Jaxon Kaizer and Amelia Martin (Roncalli); Bennett Roettele and Alice Brunmaier (Holgate); Trey Casanova and Estelle Riggs (Simmons). The Youth of Month Recipients were Paige Veskrna (Central); Brody Weinmeister (Roncalli) and Taylor Ingemansen (Aberdeen Christian).

Commissioner Wiese asked about the Public Comment Guidelines that were in the packet, if it was something for consideration and future adoption. Auditor Heupel stated it was just for their information. Commissioner Wiese asked if we had guidelines and Chairman Sutton said he read them over and said we are following the guidelines and that was one of the topics at Convention. Commissioner Wiese mentioned that these were specific guidelines they (Brookings County) adopted so wondering if we wanted to clearly define ours – it hasn’t been an issue. Chairman Sutton stated that they impressed on the Commissioners not to engage in conversation, it strictly for them to comment and move on because you don’t want it to become interactive.

EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Fjeldheim to go into Executive Session for Personnel and Contracts per SDCL 1-25-2. All members present voting aye. Motion carried. The chair declared the executive session closed with no action taken.

THANK-YOU: Chairman Sutton wanted to Thank Rachel and her crew for setting everything up at the Youth Camp for County Picnic on Saturday, Lynn and her family for organizing what they did and the Commissioners for showing up.
