BROWN COUNTY COMMISSION

AUGUST 6, 2024 – GENERAL MEETING

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Fjeldheim, Gage, Sutton, and Wiese. Commissioner Dennert led the Pledge of Allegiance.

APPROVAL OF AGENDA: Moved by Commissioner Wiese to approve the agenda, seconded by Gage. All members present voting aye. Motion carried.

OPPORTUNITY FOR PUBLIC COMMENT: None

PUBLIC HEARING – ALCOHOLIC BEVERAGE TEMPORARY PERMIT FOR SPECIAL EVENT: Moved by Commissioner Fjeldheim, seconded by Wiese to approve the following Alcoholic Beverage Temporary Permit in conjunction with a Special Event for Malt Beverage License to Boys & Girls Club of Aberdeen Area, Aberdeen, SD – Brown County Fair Grandstand – SW ¼ of Sec 1-T123N-R64W, Brown County, SD effective August 12-18, 2024. All members present voting aye. Motion carried.

DRAWDOWN REQUEST FOR LANDFILL LOADER: Moved by Commissioner Wiese, seconded by Dennert to approve and authorize Chairman Sutton to sign the drawdown request for the Landfill Loader from Water & Environment Fund through SD Dept. of Agriculture and Natural Resources Environmental Funding Program in the amount of $70,046.78. All members present voting aye. Motion carried.

FALL RESIDENTAL CLEAN-UP: Mike Scott, Landfill Manager met with the Commission asking to waive the fees at the Landfill from August 30 – September 14, 2024 for the Fall Residential Clean-up. Moved by Commissioner Wiese, seconded by Dennert to waive the Landfill Fees during the Free Fall Residential Clean-up from August 30 – September 14, 2024 at the Landfill Only. All members present voting aye. Motion carried.

BROWN COUNTY FAIR PROMO LIST UPDATED: Moved by Commissioner Dennert, seconded by Gage to approve the updated Brown County Fair Promo List. All members present voting aye. Motion carried. (Full list is on file at the Brown County Fair Office)

EXTENSION FOR FUNDING FOR SAND LAKE BRIDGE PROJECT: Dirk Rogers, Highway Superintendent met with the Commission to ask them to pass a Resolution to request an extension for the funding for the Sand Lake Bridge Project.  Dirk shared that it has been extended twice, but now D.O.T. says we need to ask for it instead of them automatically sending us the documents. He also shared this is being switched to a local letting and IMEG will be helping with the project. Dirk informed the Commission that there is another program that we request for 70% of the funds upfront, with doing 2 projects at once he feels we would qualify for this program. In the end, we will pay for 50% of the Sand Lake Bridge and roughly 5.2% of the Elm Lake Bridge but in the end, we have to front the funds.

Commissioner Dennert offered the following Resolution:

EXTENSION FOR BIG FUNDING FOR PROJECT BRF625(00)18-1

WHEREAS, The COVID Pandemic and Environmental Issues hindered project timelines;

WHEREAS, The BIG Funding for Project BRF 625(00)18-1 is set to expire at the end of the year (December 31, 2024);

NOW, THEREFORE, BE IT RESOLVED, that the Board of Brown County Commission requests an extension from SD Department of Transportation of the BIG Funding for Project BRF 625(00) 18-1.

HIGHWAY DEPARTMENT UPDATE: Dirk Rogers, Highway Superintendent gave the Commissioners a Department Update. They have finished up the Tacoma Park Road; working on the Intersection of Co. Road 11 and 14; doing prep work for the Rodeo at the Fairgrounds; will be paving 21 south of Bath and then begin working on 12W; no more chip sealing but may be able to fit a small micro-surfacing project into the FY25 Budget.

APPLICATIONS FOR OCCUPANCY FOR NORTHERN VALLEY COMMUNICATIONS (NVC): Moved by Commissioner Wiese, seconded by Fjeldheim to approve the following application submitted by NVC for occupancy of Brown County Highway #7 & #16 in Section 16,17-T126-R62 Brown County, South Dakota to replace fiber optic (installing broadband) cable. All members present voting aye. Motion carried.

Moved by Commissioner Wiese, seconded by Dennert to approve the following application submitted by NVC for occupancy of Brown County Highway #5 in Section 19,30-T128-R60 Brown County, South Dakota to install broadband cable. All members present voting aye. Motion carried.

APPLICATIONS FOR OCCUPANCY FOR NORTHERN ELECTRIC: Moved by Commissioner Wiese, seconded by Gage to approve the following application submitted by Northern Electric for occupancy of Brown County Highway #12WA in Section 13-T123N-R65W Brown County, South Dakota for primary electrical. LANDFILL TONNAGE REPORT: Moved by Commissioner Gage, seconded by Wiese to acknowledge the Landfill Tonnage Report for July 2024. All members present voting aye. Motion carried.

OTHER BUSINESS: Auditor Heupel informed the Commission that the TableTop the Vote Training they approved travel for a couple weeks ago has been moved to Sioux Falls now instead of Pierre.

Commissioner Gage shared that there will be another workday for the Brown County Fair on Saturday, August 10th from 9am to 12pm. Lunch provided afterwards, and drawings given away to those still there. Meet at the Expo Building to see where you can help.

EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Dennert to go into Executive Session for Personnel and Legal per SDCL 1-25-2. All members present voting aye. Motion carried. The chair declared the executive session closed with no action taken.
