BROWN COUNTY COMMISSION
NOTICE OF OCTOBER 28, 2025 – GENERAL MEETING MINUTES

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Dinger, Gage, Sutton and Wiese. Auditor Heupel led the Pledge of Allegiance.

APPROVAL OF AGENDA: Moved by Commissioner Wiese, seconded by Dennert to approve the agenda. All members present voting aye. Motion carried.

PUBLIC COMMENT: None

EXECUTIVE SESSION: Moved by Commissioner Dennert, seconded by Wiese to go into Executive Session per SDCL 1-25-2 for Legal regarding Contracts. All members present voting aye. Motion carried.

Chairman Sutton declared the Executive Session closed with No Action taken.

BID AWARD FOR RODEO STOCK CONTRACTORS: Rachel Kippley, Fair/Fairgrounds/Parks Manager met with the Commission regarding the Rodeo Stock Bids and shared that the Fair Board would recommend the bid from Dakota Rodeo in the amount of $109,000 for the three years: breakdown is as follows: 2026 – $35,000.00; 2027 – $36,500.00; 2028 – $37,500.00. Rejecting the bids from the following for the 2026-2028 Brown County Fair: Fetting Pro Rodeo for $315,250.00; Big Bucks Rodeo for $169.999.50; Bailey Pro Rodeo for $157,500.00 and Barnes PRCA Rodeo for $165,000.00.  Moved by Commissioner Wiese, seconded by Gage to accept the bid from Dakota Rodeo for the 2026, 2027 and 2028 Brown County Fair for the total of $109,000.00. All members present voting aye. Motion carried.

FAIRS.COM GRANT SPEAKER: Rachel Kippley, Fair/Fairgrounds/Parks Manager, informed the Commission that she has the opportunity to bring in a Guest Speaker, Ian Hill, through the Fairs.com Grant in February at no cost to the County. He talks about training and inspiration sessions for Fair Board, Sponsors and Volunteers. Commission was good with her hosting this event.

ORDINANCE #311 – SECOND READING/POSSIBLE ADOPTION: Moved by Commissioner Wiese, seconded by Gage to adopt Ordinance #311. Applicant David Sieh to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its future use: Description of property: Proposed Lot 1, “Sieh Family First Addition” in the SE1/4 of Section 13-T125N-R62W of the 5th P.M., Brown County, South Dakota (39970 121st Street; Columbia Twp.). All members present voting aye. Motion carried.

RICHMOND LANE AND DRIVE ROAD DISTRICT:

Commissioner Wiese offered the following Resolution:

RESOLUTION #2025-50

ORDER ESTABLISHING RICHMOND LANE AND DRIVE ROAD DISTRICT

BROWN COUNTY, SOUTH DAKOTA

WHEREAS, the Board of County Commissioners of Brown County, South Dakota, acting upon Petition for the formation of the proposed Richmond Lane and Drive Road District and

WHEREAS, the Board of County Commissioners of Brown County, South Dakota, in regular session, this 28th day of October 2025 in the Commissioners Chambers, Brown County, South Dakota, have determined that the proposed RICHMOND LANE AND DRIVE ROAD DISTRICT are suited to the general policies of Brown County, South Dakota, as a whole, and having determined the boundaries of the proposed district are determined and established as embracing and including a portion of the area and real properties within the boundaries of Ravinia Township.

NOW, THEREFORE, it is hereby ordered by the Board of County Commissioners of Brown County, South Dakota, that the proposed RICHMOND LANE AND DRIVE ROAD DISTRICT are suited to the general policies of Brown County, South Dakota, as a whole, and that the boundaries of said Richmond Lane and Drive Road District be, and they are, determined and established as embracing and including a portion of the area and real properties within the boundaries of Ravinia Township, specifically described as:

  • All of Richmond Drive from 378th Avenue to Richmond Lane including the portion of the E ½ of the NW ¼ which is unplatted and comprises an area approximately 40.00’ wide by 50.00’ long and connecting the east and west sides of Richmond Drive and including the cul-de-sac for Lots 1, 2, 3, 4 Keats Ninth Subdivision;
  • All of Richmond Lane south of 127th Street;
  • Lots 1, 2, 3, 4 Keats Ninth Subdivision;
  • Lot 1 Keats Sixth Subdivision;
  • Lots 1, 2, 3, 4, 5 Keats Fourth Subdivision;
  • Lot 1, Chris & Sara Allen First Richmond Lake Subdivision;
  • Lot 2 Prairie Lake Second Subdivision;
  • E.B. Water Lot 1;
  • Lots 1, 2, 3, 4, 5, 6 Prairie Lake First Subdivision;
  • Lots 9, 10, 11, 12, 13, 14 Prairie Lake First Subdivision;

and that the said Richmond Lane and Drive Road District be, and the same hereby is, established as aforesaid, pursuant to SDCL 31-12A.

That the County Auditor is hereby directed to designate a time and place for an election, pursuant to law to determine if the organization of the Richmond Lane and Drive Road Distrct shall be completed.

PROPERTY TAXES: Gene Loeschke, Director of Equalization informed everyone that at this time only the Landowners will be paying taxes for this Road District but if the property taxes are abolished resolution is passed by the Legislators, and money is centrally collected everyone across the County and State will be paying into this Road District. Local Control is very important. Going forward it will be more difficult to create road districts, townships secondary road capital improvements, etc. Gene just wants the people to be aware of the repercussions of the proposed property tax legislation.

BUDGET SUPPLEMENT: Moved by Commissioner Dennert, seconded by Gage to approve the $200,000.00 Budget Supplement for the Maintenance Department from the Assigned Fund Balance. All members present voting aye. Motion carried.

APPLICATIONS FOR OCCUPANCY: Moved by Commissioner Dennert, seconded by Wiese to approve the following applications submitted by Northern Electric for occupancy of Brown County Highway 16 in Section 7-T123-R62, Brown County, South Dakota and Brown County Highway 16 in Section 5-T123-R62, Brown County, South Dakota to bore for electrical utility infrastructures. All members present voting aye. Motion carried.

Moved by Commissioner Wiese, seconded by Dinger to approve the following application submitted by Basin Construction & Drain Tile for occupancy of Brown County 142nd Avenue in Section SW33-T122N-R62W, Brown County, South Dakota to bore for drainage of the drain tile. All members present voting aye. Motion carried.

HIGHWAY DEPARTMENT UPDATE: Dirk Rogers, Highway Superintendent, informed the Commission that they are finished on 27 and starting to work on the North Parking Lot here at the Courthouse. They are still doing some patching and getting the equipment ready for the plowing snow. They are behind on mowing but continuing to get it done.

Commissioner Dinger brought the following Resolution “Be it resolved by the County Commission of Brown County, South Dakota, that the plat showing WEST HANSON-MUD CREEK ADDITION in the SW ¼ of Section 11, Township 122 North, Range 61 West of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof. Seconded by Dennert. All members present voting aye. Resolution adopted.

SIEDSCHLAG FIRST ADDITION PLAT:

Commissioner Wiese brought the following Resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota, that the plat showing SIEDSCHLAG FIRST ADDITION in the SW ¼ of Section 13-T124N-R65W of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof. Seconded by Gage. All members present voting aye. Resolution adopted.

PAUL LARSON SECOND ADDITION PLAT:

Commissioner Dennert brought the following Resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota, that the plat showing PAUL LARSON SECOND ADDITION in the E ½ SE ¼ of Section 6-T122N-R63W of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof. Seconded by Wiese. All members present voting aye. Resolution adopted.

CHRIS & SARA ALLEN SECOND RICHMOND LAKE SUBDIVISION PLAT:

RESOLUTION #2025-54

Commissioner Dinger brought the following Resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota, that the plat showing CHRIS AND SARA ALLEN SECOND RICHMOND LAKE SUBDIVISION in the NW ¼ of Section 23-T124N-R65W of the 5TH P.M., Brown County, South Dakota” having been examined is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof. Seconded by Wiese. All members present voting aye. Resolution adopted.

OTHER BUSINESS: Chairman Sutton stated on behalf of Brown County Commission and Employees, like to extend a sincere regret on the loss of John Vander Hoek. He was a 28-year employee in the Sheriff’s Department, who passed away on Sunday. Thoughts and prayers go out to the Vander Hoek Family.
