BROWN COUNTY COMMISSION

JUNE 24, 2025 – GENERAL MEETING

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Gage, Sutton and Wiese. Commissioner Dinger was absent. Commissioner Wiese led the Pledge of Allegiance.

APPROVAL OF AGENDA: Chairman Sutton shared that the Avera Addiction Care Center staff was unable to attend today so they have been scratched on the agenda. Moved by Commissioner Wiese, seconded by Dennert to approve the amended agenda. All members present voting aye. Motion carried.

OPPORTUNITY FOR PUBLIC COMMENT: None

BROWN COUNTY FAIR CONTRACTS: Rachel Kippley, Fair/Fairgrounds/Parks Manager met with the Commission to ask them to approve and authorize Chairman to sign the Reassignment Contract from Neste Live to Fran Romeo Agency along with the Entertainment Addendum Contracts. Moved by Commissioner Wiese, seconded by Dennert to approve and authorize Chairman Sutton to sign the Agreement for Contract Reassignment from Neste Live to Fran Romeo Agency at the cost of $24,999.99 for 2025 & 2026; along with the addendums for the following Entertainment Contracts: Avery Anna; Ian Munsick; Ned LeDoux; Tracy Lawrence; Uncle Kracker; 38 Special; Redferrin & Dustin Lynch. All members present voting aye.  Motion carried.

MINUTES: Moved by Commissioner Wiese, seconded by Gage to approve the General Meeting Minutes of June 17, 2025. All members present voting aye. Motion carried.

HR REPORT: Moved by Commissioner Dennert, seconded by Wiese to approve the following Human Resource Report submitted by Human Resources Director, Allison Tunheim:

  • Hiring of Mycah Trollen as Brown County Jail Detention Officer, FT; starting wage $21.93/hr. – effective June 24, 2025.

All members present voting aye. Motion carried.

CLAIM ASSIGNMENTS: Moved by Commissioner Dennert, seconded by Gage to approve and authorize Auditor Heupel to sign the Claim Assignments against individuals to Credit Collections Bureau for the purpose of collecting liens. All members present voting aye. Motion carried.

LOTTERY PERMITS: Moved by Commissioner Gage, seconded by Wiese to approve and authorize Chairman Sutton to sign the applications submitted by Richmond Lake Association for July 26, 2025 to raise funds for Edwards Preserve Project. All members present voting aye. Motion carried.

LEASE AGREEMENT: Moved by Commissioner Wiese, seconded by Dennert to defer the lease agreement for the Dakota Horizons Girl Scouts to rent the Richmond Lake Youth Camp on July 12-18, 2025 due to no agreement/contract being signed yet. All members present voting aye. Motion carried.

TEMPORARY SPECIAL EVENT ALCOHOL LICENSE PERMIT HEARING FOR RICHMOND LAKE ASSN: Moved by Commissioner Wiese, seconded by Gage to authorize advertising public hearing for the following Special Alcohol License Permit: Richmond Lake Association, Aberdeen SD for Poker Run to be held at Richmond Pavilion, Richmond Resort Outlot 2 in the NE ¼ Section 25-T124N-R65W Brown County, SD on July 15, 2025. (Temporary Special Event Alcohol License effective July 26, 2025). All members present voting aye. Motion carried.

TRAVEL REQUESTS: Moved by Commissioner Gage, seconded by Wiese to approve the following travel requests: Austin Ball, Sheriff’s Department, to attend Blue to Gold Advanced Criminal Investigations on September 25, 2025 in Pierre and Proactive Patrol for Rural Areas Training on July 23-25, 2025 in Tea. All members present voting aye. Motion carried.

ZONING ORDINANCES – SET HEARING DATE/AUTHORIZE ADVERTISING: Moved by Commissioner Wiese, seconded by Gage to set hearing date and authorize publication for the first reading of the following zoning ordinances to be held on July 15, 2025, in the Commission Chambers, Courthouse Annex, Brown County, South Dakota. Proposed Ordinance #304, applicant Dawn Weismantel for the purpose of rezoning from Agriculture Preservation District (AG-P) to Mini Agriculture District (M-AG) to bring these parcels into compliance for their current use: Description of property: Proposed Lots 1 & 2, “Weismantel Farm First Addition” in the E 1/2 of the NE 1/4 of Section 33-T126N-R62W of the 5th P.M., Brown County, South Dakota (11747 397th Avenue; Shelby Twp.). Proposed Ordinance #305, applicants Earl & Amanda Maier for the purpose of rezoning from Agriculture Preservation District (AG-P) to Mini Agriculture District (M-AG) to bring this parcel into compliance for its current use: Description of property: Proposed Lot 1, “Maier’s First Addition” in the SW 1/4 of Section 17-T126N-R63W of the 5th P.M., Brown County, South Dakota (11450 389th Avenue; Brainard Twp.). PIGORS THIRD ADDITION PLAT:

Resolution #2025-25

Commissioner Dennert brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing “PIGORS THIRD ADDITION IN THE SE ¼ OF SECTION 27-T122N-R60W OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA” having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.” Seconded by Gage. Scott Bader, Planning & Zoning Director, informed the Commission this plat will not be filed until October due to the second half of taxes won’t be paid until then. All members present voting aye. Resolution adopted.

WEISMANTEL FARM FIRST ADDITION PLAT:

Resolution #2025-26

Commissioner Gage brought the following resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing “WEISMANTEL FARM FIRST ADDITION IN THE E ½ NE ¼ OF SECTION 33-T126N-R62W OF THE 5TH P.M. BROWN COUNTY, SOUTH DAKOTA” having been examined, is hereby approved in accordance with the provision of SDCL 11-3, and any amendments thereof.” Seconded by Wiese. All members present voting aye. Resolution adopted.

MAIER’S FIRST ADDITION PLAT:

Resolution #2025-27

Commissioner Gage brought the following resolution “Be it resolved by the Board of Commissioners of Brown County, South Dakota, that the plat showing “MAIER’S FIRST ADDITION IN THE SW ¼ OF SECTION 17-T126N-R63W OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA”, having been examined is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.” Seconded by Dennert. All members present voting aye. Resolution adopted.

MINA LAKE NORTHEAST ADDITION PLAT:

Resolution #2025-28

Commissioner Gage brought the following resolution “Be it resolved by the County Commission of Brown County, South Dakota, that the plat showing “MINA LAKE NORTHEAST ADDITION IN THE S ½ OF SECTION 7, TOWNSHIP 123 NORTH, RANGE 65 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.” Seconded by Wiese. All members present voting aye. Resolution adopted.

TC WRIGHT ADDITION PLAT:

Resolution #2025-29

Commissioner Dennert brought the following resolution “Be it resolved by the County Commission of Brown County, South Dakota, that the plat showing “TC WRIGHT ADDITION IN THE NW ¼ OF SECTION 20, TOWNSHIP 123 NORTH, RANGE 62 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.” Seconded by Wiese. All members present voting aye. Resolution adopted.

CWE ADDITION PLAT:

Resolution #2025-30

Commissioner Gage brough the following resolution “Be it resolved by the County Commission of Brown County, South Dakota that the plat showing “CWE ADDITION IN THE N ½ OF SECTION 29, TOWNSHIP 123 NORTH, RANGE 60 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.” Seconded by Wiese. All members present voting aye. Resolution adopted.

OTHER BUSINESS: None

EXECUTIVE SESSION: Move by Wiese, seconded by Dennert to go into Executive Session for Legal and Personnel per SDCL 1-25-2. All members present voting aye. Motion carried.

The Chair declared the Executive Session closed with No Action taken.

ADJOURNMENT: Moved by Commissioner Wiese, seconded by Gage to adjourn the Brown County Commission at 9:23 a.m. All members present voting aye. Motion carried.
