MARCH 24, 2026 MEETING MINUTES

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Dinger, Gage, Sutton and Wiese. Commissioner Gage led the Pledge of Allegiance.

APPROVAL OF AGENDA: Moved by Commissioner Wiese, seconded by Dinger to approve the agenda. All members present voting aye. Motion carried.

PUBLIC COMMENT: None

BID OPENING FOR ASPHALT CONCRETE PLANT MIX MATERIALS: Time and place, as advertised, to open, read and consider sealed bids for producing, furnishing all materials and delivery of Asphalt Concrete Plant Mix Materials for road maintenance and construction on Brown County System of Roads, F.O.B. Brown County, South Dakota. Bids received were as follows:

AMEND GRAVEL BIDS: Gravel Bid from Althoff was in the wrong packet, so Dirk Rogers, Highway Superintendent, asked to amend the Gravel Bids to include the following bids:

Moved by Commissioner Dinger, seconded by Wise to amend and include all the bids from Althoff as well based on availability per Dirks recommendation. All members present voting aye. Motion carried.

DEPARTMENT UPDATE: Dirk Rogers, Highway Superintendent, gave the Commission a Department Update: they are working on crack sealing; signing and may start to haul pea rock from Summit. Commissioner Wiese asked for an update on the Columbia bridge, Dirk shared they are precasting the beams in Sioux Falls and he thinks they will start around July. Dirk shared that he received a phone call regarding the Elm Lake Bridge but nothing new. Dirk asked about putting a shoulder on Richmond Road and the impact that it would have on landowners; consensus was that it shouldn’t impact too many because the homes sit further back on the property.

AWARD BID FOR LANDFILL CELL #5: Mike Scott, Landfill Manager and Leif Redinger, Helms Associates informed the Commission that Foothills Contracting had contacted them to withdraw their bid due to an error on their part. They recommended awarding the bid to Midland Contracting and asked for Chairman to sign the Notice of Award at the cost of $2,524,525.07. Moved by Commissioner Wiese, seconded by Dennert to award the Landfill Cell #5 bid to Midland Contracting and authorize Chairman Sutton to the sign the Notice of Award to Midland Contracting for $2,524,525.07. All members present voting aye. Motion carried.

BID DATE SET FOR WASTE TIRE REMOVAL AT LANDFILL: Moved by Commissioner Dinger, seconded by Gage to approve and authorize advertising public hearing to open, read and consider bids for Waste Tire Removal to be held on April 14, 2026 in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. All members present voting aye. Motion carried.

BID DATE SET FOR WOOD WASTE GRINDING AT LANDFILL: Moved by Commissioner Wiese, seconded by Dinger to approve and authorize advertising public hearing to open, read and consider bids for Wood Waste Grinding to be held on April 14, 2026 in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. All members present voting aye. Motion carried

WAIVE FEES FOR SPRING CLEAN-UP AT THE LANDFILL: Mike Scott, Landfill Manager, asked the Commission to the waive the tipping fees during the Spring Clean-up that will run from April 24 – May 2, 2026. On Saturday, April 25, 2026 they will do a drop off site at Jensen Rock & Sand from 8am to 5pm. Otherwise, the loads need to be covered and secured and taken to the Landfill from 8am to 5pm Monday – Saturday. No 8th Ave. Access. Moved by Commissioner Wiese, seconded by Gage to approve waving the tipping fees during the Spring Clean-up from April 24 through May 2, 2026. All members present voting aye. Motion carried.

NOXIOUX WEED NOTICE: Moved by Commissioner Dennert, seconded by Dinger to approve and authorize publishing Noxious Weed Notice. All members present voting aye. Motion carried.

FAIR CONTRACTS: Moved by Commissioner Gage, seconded by Wiese to approve and authorize Chairman Sutton to sign the Entertainment Contracts which details are confidential for Tyler Hubbard, Cooper Alan, Jackson Dean and Addendums for George Birge and Lee Brice. All members present voting aye. Motion carried.

LOCAL EMERGENCY MANAGEMENT PERORMANCE GRANT (LEMPG): Moved by Commissioner Wiese, seconded by Gage to approve and authorize Chairman Sutton to sign the 2nd quarter LEMPG Grant Report. All members present voting aye. Motion carried.

TRANSFER VEHICLE FROM SHERIFF TO EQUALIZATION: Moved by Commissioner Wiese, seconded by Dennert to approve transferring 2018 Ford Explorer from Sheriff Department to Department of Equalization. All members present voting aye. Motion carried.

SURPLUS PROPERTY: Moved by Commissioner Wiese, seconded by Gage to approve to surplus 2 – 2020 Ford Explorers and a 2016 Ford Explorer and sell at auction. All members present voting aye. Motion carried.

  • Retirement of Penny Hart as Brown County State’s Attorney Legal Assistant, PT; effective March 23, 2026. Request to fill.
  • Approve the payment of Retirement Award for Penny Hart in the amount of $150.00 before taxes, requirement was met.
  • Hiring of the following Temporary Election Workers from April 13th to June 5th at $16.00/hour:

ZONING ORDINANCE-SET HEARING DATE/AUTHORIZE ADVERTISING: Moved by Commissioner Gage, seconded by Wiese to set hearing date and authorize publication for the first reading of the following zoning ordinance to be held on Tuesday, April 14, 2026 in the Commission Chambers, Courthouse Annex, Brown County, South Dakota. Proposed Ordinance #323, applicant Darin & Sarah Lowe for the purpose of rezoning from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its current use: Description of property: The West 720’ of the South 1097’ in the NE1/4 of Section 30-T125N-R61W of the 5th P.M., except that portion deeded for highway purposes, Brown County, South Dakota (40058 Larson Road; Columbia Twp.). All members present voting aye. Motion carried.

WW RENTALS SECOND ADDITION PLAT:

Commissioner Wiese brought the following Resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing “WW RENTALS SECOND ADDITION” to the city of Columbia, in the NE ¼ of Section 29-T125N-R62W of the 5TH P.M., Brown County, South Dakota having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.” Seconded by Gage. All members present voting aye. Resolution adopted.

ROETTELE FIRST ADDITION PLAT:

RESOLUTION #2026-17

Commissioner Dennert brought the following Resolution “Be it resolved by the Board of County Commissioners of Brown County, South Dakota that the plat showing “ROETTELE FIRST ADDITION” in the NW ¼ of Section 30-T125N-R62W of the 5TH P.M., Brown County, South Dakota having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.” Seconded by Wiese. All members present voting aye. Resolution adopted.

OTHER BUSINESS: None

EXECUTIVE SESSION: Moved by Commissioner Wiese, seconded by Dinger to go into Executive Session per SDCL 1-25-2 for Personnel and Legal. All members present voting aye. Motion carried.

Chairman Sutton declared the Executive Session closed with No Action taken.

ADJOURNMENT: Moved by Commissioner Dennert, seconded by Wiese to adjourn the Brown County Commission at 10:51 a.m. All members present voting aye. Motion carried.
