APRIL 28, 2026 GENERAL MEETING MINUTES

Meeting called to order by Chairman Sutton at 8:45 A.M. in the Commission Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Dennert, Dinger, Gage, Sutton and Wiese. Commissioner Gage led the Pledge of Allegiance.

APPROVAL OF AGENDA: Chairman Sutton shared needing to add Masa contract under the Benefit Contracts. Moved by Commissioner Wiese, seconded by Gage to approve the amended agenda. All members present voting aye. Motion carried.

PUBLIC COMMENT: Dirk Rogers, Highway Superintendent, shared that he will not be extending the Load Limits so they will expire at midnight on April 30, 2026. Also informed the Commission that they did add 384th Ave. to the Richmond Dam Detour, there will be no blotter put on the roads, and they will be reimbursed for the dust proofing that was done.

BID OPENING – COLD IN-PLACE PROJECT RECYCLING PROJECT: Time and place, as advertised to open, read and consider bids for 2026 Brown County Cold In-Place Recycling Project for the Brown County Highway Department. Two bids were received: All State Pavement Recycling & Stabilization in the amount of $617,734.70 and Midstate Reclamation S.D., LLC in the amount of $694, 946.52. Dirk Rogers, Highway Superintendent, asked to defer the decision so Mike Gutenkauf from IMEG could review the bids. Moved by Commissioner Wiese, seconded by Dennert to defer the bids for review. All members present voting aye. Motion carried.

ORDINANCE #323 – SECOND READING/POSSIBLE ADOPTION: Moved by Commissioner Dennert, seconded by Dinger to adopt Ordinance #323. Applicant Darin & Sarah Lowe to rezone from Agriculture Preservation District (AG-P) to Mini-Agriculture District (M-AG) to bring this parcel into compliance for its current use. Description of property: The West 720’ of the South 1097’ in the NE1/4 of Section 30-T125N-R61W of the 5th P.M., except that portion deeded for highway purposes, Brown County, South Dakota (40058 Larson Road; Columbia Twp.). All members present voting aye. Motion carried.

VICTIMS OF CRIME ACT GRANT: Moved by Commissioner Wiese, seconded by Gage to approve and authorize Chairman Sutton to sign the letter of approval for State’s Attorney’s Office to apply for the Victims of Crime Act (VOCA) Grant. All members present voting aye. Motion carried.

AWARD BID FOR COLD-IN PLACE RECYLING PROJECT: Dirk Rogers, Highway Superintendent, recommended the Cold-In Place Recycling Project Bid to All State Pavement Recycling & Stabilization in the amount of $617,734.70. Moved by Commissioner Dinger, seconded by Dennert to award the bid to All State Pavement Recycling & Stabilization for $617,734.70. All members present voting aye. Motion carried.
