12/23/24 MINUTES

ABERDEEN CITY COUNCIL MEETING

City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, December 23, 2024, at 5:30 p.m., regular meeting of the City Council.

CALL TO ORDER

MEETING ROLL CALL

            Present at roll call were City Council Members Rob Ronayne, Erin Fouberg via teleconference, Charlotte Liebelt, Rich Ward via teleconference, Alan Johnson, Justin Reinbold, David Novstrup, and Mayor Travis Schaunaman.  Councilwoman Tiffany Langer was absent.

City Staff present were Robin Bobzien, Ron Wager, Stuart Nelson, Ken Hubbart, Joel Weig, Rich Krokel, Dave McNeil, and Jordan McQuillen.

PLEDGE OF ALLEGIANCE

Mayor Schaunaman led the Pledge of Allegiance.

Councilwoman Langer joined the meeting at 5:31 p.m. via teleconference.

APPROVAL OF AGENDA

Motion by Liebelt, second by Reinbold, to approve the agenda. Voice vote to approve, all present voting aye, motion carried.

MINUTES

Motion by Reinbold, second by Johnson, to approve the minutes of the December 16, 2024, City Council Meeting, as amended. Voice vote to approve, all present voting aye, motion carried.

OPEN FORUM

No one appeared in open forum to address the Council.

OLD BUSINESS

APPROVAL OF ORDINANCE 24-12-05 AMENDING CABLE TELEVISION FRANCHISE AGREEMENT WITH MIDCONTINENT COMMUNICATIONS TO DELETE IN-KIND SERVICES

City Attorney Wager presented the agreement. Motion by Liebelt, second by Reinbold, to approve Ordinance 24-12-05 amending cable television franchise agreement with Midcontinent Communications to delete in-kind services. Roll call vote to approve, all present voting aye, motion carried.

SECOND READING AND FINAL ADOPTION OF ORDINANCE 24-12-02 SUPPLEMENTING THE 2024 BUDGET TO APPROPRIATE FUNDS FOR VARIOUS UNANTICIPATED PROJECTS, ACTIVITIES, AND EXPENDITURES

Finance Officer McQuillen presented Ordinance 24-12-02. Motion by Johnson, second by Ronayne, to approve the second reading and final adoption of Ordinance 24-12-02 supplementing the 2024 budget to appropriate funds for various unanticipated projects, activities, and expenditures. Roll call vote to approve, all present voting aye, motion carried.

SECOND READING AND FINAL ADOPTION OF ORDINANCE 24-12-06 SUPPLEMENTING THE 2024 BUDGET FOR VARIOUS PARKS, RECREATION, AND FORESTRY DEPARTMENT ACTIVITIES

Finance Officer McQuillen presented Ordinance 24-12-06. Motion by Liebelt, second by Novstrup, to approve the second reading and final adoption of Ordinance 24-12-06 supplementing the 2024 budget for various Parks, Recreation, and Forestry Department activities. Roll call vote to approve, all present voting aye, motion carried.

SECOND READING OF ORDINANCE NO. 24-12-03 AND POSSIBLE APPROVAL OF A REZONE FROM R-1 TO M – PROPERTY AT 2002 FIFTH STREET N – FORMER PRESENTATION COLLEGE NORTH SUITES

Community Development Director Hubbart presented the second reading of Ordinance 24-12-03. Motion by Johnson, second by Ronayne, to approve the Second reading of Ordinance No. 24-12-03 and possible approval of a Rezone from R-1 to M – Property at 2002 Fifth Street N – Former Presentation College North Suites. Roll call vote to approve, all present voting aye, motion carried.

NEW BUSINESS

PUBLIC HEARING AND POSSIBLE APPROVAL OF RESOLUTION 23-12-05R AUTHORIZING AN APPLICATION FOR FINANCIAL ASSISTANCE, AUTHORIZING THE EXECUTION, AND SUBMITTAL OF THE APPLICATION, AND DESIGNATING AN AUTHORIZED REPRESENTATIVE TO CERTIFY AND SIGN PAYMENT REQUESTS

Mayor Schaunaman opened the public hearing for consideration of an application for $30,000,000 in funding from the Board of Agriculture and Natural Resources for increasing efficiencies and capacity of Aberdeen’s Wastewater Treatment Facility. The funds could be either a grant from the state Consolidated Water Facilities Construction Program or a loan from the Clean Water State Revolving Fund (SRF) Program. The Clean Water SRF loan terms are up to 5% for 30 years, and the Board of Agriculture and Natural Resources may forgive all or a portion of loan principal. The amount, source of funds, and terms will be determined by the Board of Agriculture and Natural Resources when the application is presented at a scheduled board meeting. Finance Officer McQuillen presented Resolution 23-12-05R. Additional information was presented by Lesleann Palmer, Community Development Specialist from the Northeast Council of Governments. Motion by Ronayne, second by Reinbold, to approve Resolution 23-12-05R authorizing an application for financial assistance, authorizing the execution, and submittal of the application, and designating an authorized representative to certify and sign payment requests. Roll call vote to approve, all present voting aye, motion carried.

APPROVAL OF RESOLUTION 24-12-03R TO APPROVE THE OBLIGATION OF STATE AND LOCAL FISCAL RECOVERY FUNDS FOR THE WATER RECLAMATION FACILITY IMPROVEMENTS PHASE 1 PROJECT

Finance Officer McQuillen presented Resolution 24-12-03R. Motion by Reinbold, second by Liebelt, to approve Resolution 24-12-03R to approve the Obligation of State in the amount of $5,110,164.00 and Local Fiscal Recovery Funds for the Water Reclamation Facility Improvements Phase 1 Project. Roll call vote to approve, all present voting aye, motion carried.

APPROVAL OF RESOLUTION 24-12-04R DISSOLVING TAX INCREMENT FINANCING DISTRICT NUMBER 18

Finance Officer McQuillen presented Resolution 24-12-04R. Motion by Johnson, second by Ronayne, to approve Resolution 24-12-04R Dissolving Tax Increment Financing District Number 18. Roll call vote to approve, all present voting aye, motion carried.

PUBLIC HEARING AND FIRST READING OF ORDINANCE 24-12-04 FOR THE REZONE FROM R-2 TO M – PROPERTY AT 2200, 2240 & 2302 ROOSEVELT ST S – ABERDEEN CENTRAL HIGH SCHOOL CAMPUS

Mayor Schaunaman opened the public hearing and Community Development Director Hubbart presented Ordinance 24-12-04. Motion by Reinbold, second by Johnson, to approve the first reading of Ordinance 24-12-04 for the Rezone from R-2 to M – Property at 2200, 2240 & 2302 Roosevelt St S – Aberdeen Central High School Campus. Roll call vote to approve, all present voting aye, motion carried.

APPROVAL OF REQUEST TO DECLARE CERTAIN UNPAID AMBULANCE ACCOUNTS UNCOLLECTIBLE AND ALLOW THE FIRE DEPARTMENT TO WRITE OFF THE BALANCES

Fire Chief Weig presented the write off request that would declare $25,945.51 as uncollectable and authorize $222,067.28 in unpaid balances to be submitted for collections by an outside agency. Motion by Liebelt, second by Novstrup, to approve the request to declare certain unpaid ambulance accounts uncollectible and allow the Fire Department to write off the balances. Roll call vote to approve, all present voting aye, motion carried.

APPROVAL TO DECLARE SURPLUS AND SALE OF PILES OF CONCRETE AND ASPHALT FROM THE NORTH AND SOUTH DUMP SITES TO LIEN TRANSPORTATION IN THE AMOUNT OF $27,557.00

City Attorney Wager/City Engineer Nelson presented the surplus and sale request. Motion by Ronayne, second by Johnson, for approval to declare surplus and sale of piles of Concrete and Asphalt from the North and South Dump sites to Lien Transportation in the amount of $27,557.00. Roll call vote to approve, all present voting aye, motion carried.

CITY MANAGER’S REPORT

City Manager Robin Bobzien deliberated on the ribbon cutting at Baird Park, a meeting with the Corps of Engineers and informed a new flood mapping will be made by FEMA, and employee milestones were recognized.
