RESOLUTION NO. 25-02-01R
RESOLUTION TO EXCHANGE LAND WITH PRIVATE OWNER
WHEREAS, the City of Aberdeen by Resolution No. 24-11-01R declared certain real property as surplus, said land described as:
Parcel 1: 0.33 acre± in LOT 15, GUGEL’S SECOND SUBDIVISION, IN THE SOUTH HALF OF SECTION 6, TOWNSHIP 123 NORTH, RANGE 63 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA.
Parcel 2: 0.33 acre± in LOT 16, GUGEL’S SECOND SUBDIVISION, IN THE SOUTH HALF OF SECTION 6, TOWNSHIP 123 NORTH, RANGE 63 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA.
Parcel 3: 0.26 acre± in THAT VACATED EAST 174.3′ OF THE 66′ WIDE TWENTY FIFTH AVENUE NE PUBLIC R.O.W. ADJACENT TO LOTS 15 & 16, GUGEL’S SECOND SUBDIVISION, LOT 2, BLOCK 4, MEADOWS ON DAKOTA SECOND SUBDIVISION, LOT 1, LEVEE ADDITION, AND LEVEE LOT 1 OF BAIRD’S SUBDIVISION, ALL LOCATED IN THE SOUTH HALF OF SECTION 6, TOWNSHIP 123 NORTH, RANGE 63 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA; and
WHEREAS, Homes Are Possible, Inc., a South Dakota nonprofit corporation, owns land described as:
Parcel 4: 6.99 acres± in LOT 7, BLOCK 6 IN HAPI 2ND NORTH SUBDIVISION TO THE CITY OF ABERDEEN, IN THE SOUTH HALF OF SECTION 6, TOWNSHIP 123 NORTH, RANGE 63 WEST OF THE 5TH P.M., BROWN COUNTY, SOUTH DAKOTA; and
WHEREAS, Homes Are Possible, Inc., desires, pursuant to SDCL § 9-27-34.1, to exchange Parcel 4 for Parcels 1, 2, and 3 for affordable housing residential development of such surplus parcels for low to moderate-income families consistent with its developments north and west of the surplus property; and
WHEREAS, a notice of public hearing was published as required by law and the hearing was held by the City Council in City Council Chambers at 5:30 p.m., on February 24, 2025, in which all persons interested in the proposed exchange were permitted to appear and be heard; and
WHEREAS, the exchange is recommended by the City Manager as Parcel 4 will be utilized by the City for storm water management and could be programmed and developed by the City as a neighborhood park; and
WHEREAS, no person appeared in opposition to the proposed exchange; and
WHEREAS, the City caused the proposed parcels of land to be appraised by a state- licensed appraiser who determined that Parcel 1, Parcel 2, and Parcel 3 have a combined value of
$124,000, which total is comparable to the appraised value of $126,000.00 for Parcel 4; and
WHEREAS, Homes Are Possible, Inc., will pay all costs associated with transferring the property between it and the City, including title insurance, filing fees, deed preparation, and re- platting the subject lots.
NOW, THEREFORE, BE IT RESOLVED that the Aberdeen City Council, pursuant to SDCL § 9-27-34.1, hereby approves the exchange of the real property described above for and on behalf of the City of Aberdeen and authorizes the City Manager to execute any documents necessary to effectuate the exchange with Homes Are Possible, Inc.
