ORDINANCE NO. 25-07-03
AN ORDINANCE REPEALING DRONE OPERATION REGULATIONS
WHEREAS, in the nine years since the City of Aberdeen adopted Ordinance No. 15-12-04 to address the potential threats by drone operations to the public health, safety, and welfare, including, but not limited to, privacy, nuisance, and trespass concerns, their operation has become comprehensively regulated by South Dakota law at SDCL Ch. 50-15, and by the Federal Aviation Administration and U.S. Department of Transportation; and
WHEREAS, the City Council is charged with protecting the health, safety, and property, and the reasonable security and repose of the citizens of, and visitors to, the City of Aberdeen and to defer to those state and federal laws and regulations which adequately serve those purposes; and
WHEREAS, the City Council has determined it is in the public interest to repeal those sections of the Aberdeen City Code City regulating drone operation.
BE IT ORDAINED BY THE CITY OF ABERDEEN THAT THE FOLLOWING CHANGES AND ADDITIONS SHALL BE MADE TO THE ABERDEEN CITY CODE:
1. Article I – In General, of Chapter 50 – AVIATION, consisting of Sections 10-1 through 10-4 are hereby repealed.
- Severability. The provisions of this ordinance are severable. If any provision of this ordinance or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application.
- Effective Date. The City Finance Officer shall cause this ordinance to be published in the official newspaper in clean text with all deletions and additions incorporated therein and footnotes omitted.
