RESOLUTION AUTHORIZING CLASS ACTION CLAIMS FILING
AND SUPERVISION OF SETTLEMENT DISTRIBUTIONS
ON BEHALF OF THE CITY OF ABERDEEN
WHEREAS, SDCL § 9-12-1 grants a municipality the general power to sue and join lawsuits on its behalf and to litigate such lawsuits; and
WHEREAS, the City of Aberdeen is regularly solicited to join national class action lawsuits for claims involving municipalities and local governments and to submit claims and participate in court-approved settlement distributions resolving such lawsuits; and
WHEREAS, the City Attorney monitors such class actions as regular administrative practice for and on behalf of the City and desires to formalize the authority of the City Attorney and the City Manager to submit class action claims and execute documents required for the distribution and compliance requirements of settlement funds.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Aberdeen that the City Attorney and City Manager are authorized to file national class action claims on behalf of the City of Aberdeen, to execute documents required in such class actions to participate in settlement distributions, and to comply with auditing and reporting requirements of the settlements.
BE IT FURTHER RESOLVED that the City Attorney shall at least annually report to the City Council the status of any class action lawsuit joined by the City.
The foregoing Resolution was approved and adopted at a regular meeting of the Aberdeen City Council on the 20th day of July, 2026.
