RESOLUTION NO. 25-06-02R
RESOLUTION DECLARING THE RECOUNT RESULTS OF THE MUNICIPAL
ELECTION FOR SOUTHEAST DISTRICT CITY COUNCIL MEMBER
WHEREAS, on June 3, 2025, there was held in the City of Aberdeen, South Dakota, a Municipal Election for the purpose of electing a City Council Member – Southwest District and a City Council Member – Southeast District for five-year terms; and
WHEREAS, the returns of said election were delivered by the County Auditor and canvassed by the City Council on June 6, 2025, wherein it adopted Resolution No. 25-06-01R declaring Talmage Ekanger the winner of the election for Office of City Council Member – Southwest District, and further declaring Chad Nilson the winner of the election for Office of City Council Member – Southeast District, to wit: Chad Nilson received 124 votes, Kurt Preszler received 123 votes, and Tiffany Langer received 79 votes, there being a total of 326 legal votes cast; and
WHEREAS, Kurt Preszler, as a candidate defeated for Office of City Council Member – Southeast District by a margin of one vote, on June 10, 2025, filed with the Finance Officer a written request for recount pursuant to SDCL § 9-13-27.3; and
WHEREAS, the recount board established in accordance with law and consisting of Chad Lyke, chosen by Chad Nilson, Rich Hilgemann, chosen by Kurt Preszler, and Angie Cleberg, appointed by the Finance Officer and mutually agreeable to each candidate, on June 16, 2025, beginning at 3:00 p.m., conducted and completed at the office of the County Auditor a recount of the ballots delivered to it; and
WHEREAS, the recount board issued its Certificate Of Recount determining the votes for Office of City Council Member – Southeast District as follows: Chad Nilson received 124 votes, Kurt Preszler received 123 votes, and Tiffany Langer received 79 votes, there being a total of 326 legal votes cast.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ABERDEEN that, following the recount authorized and conducted according to law, Chad Nilson received a plurality of the legal votes cast for Council Member – Southeast District and is declared the winner.
BE IT FURTHER RESOLVED that the City Finance Officer is hereby directed to issue the Certificate of Election to Chad Nilson, elected City Council Member – Southeast District, for the five-year term beginning July 1, 2025. Such Certificate of Election shall be treated, in accordance with SDCL § 12-21-41, as an original certificate and supersede and render null and void any certificate previously issued.
