ORDINANCE NO. 24-12-01

AN ORDINANCE ADJUSTING THE CITY FEE SCHEDULE FOR 2025

SETTING CERTAIN FEES AND CHARGES FOR SERVICES

PROVIDED BY THE CITY OF ABERDEEN

            WHEREAS, the City of Aberdeen provides numerous services, utilities, and public enterprises and enforces Aberdeen City Code and ordinance requirements which are supported financially by various fees, fines, penalties, deposits, and charges as allowed by South Dakota Codified Law; and

            WHEREAS, the various municipal fees, fines, penalties, deposits, and charges are annually set by ordinance in a city fee schedule as required by Aberdeen City Code, Sec. 1-17; and

            WHEREAS, the City of Aberdeen Park and Recreation Board, as authorized by ordinance and South Dakota Codified Law, annually establishes the various fees, charges, and deposits for the provision of the municipal park services, recreation services, and cemetery services which it supervises and controls; and

WHEREAS, the Park and Recreation Board at its regular meeting on November 6, 2024, approved a schedule of fees, charges, and deposits for program and department services known as the “2025 Fees & Charges”.

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF ABERDEEN AS FOLLOWS:

Section 1.  City Fees And Related Charges for 2025.  The Aberdeen City Council hereby sets the following 2024 city fee schedule of fees, fines, penalties, deposits, and charges as provided below:

ABATEMENT BY CODE ENFORCEMENT: All property maintenance abatements: $220, or Actual Cost plus Processing Fee, whichever is greater. Abatement under “Nuisance Vacant Building Registration”: – Actual Cost plus Processing Fee, or fee owed under “Nuisance Vacant Building Registration” plus Processing Fee, whichever is greater. Private Service 3-year License – Second Ambulance: $60. Private Service 3-year License – Each Additional Ambulance: $20. Ambulance Driver License – New: per year $20. Ambulance Driver License – Renewal: per year $15. EMS Records Request: $30. AMBULANCE TRAINING FEE (PER STUDENT): BLS-Instructor Lead: $65. BLS-Heart Code -Skills: $35. ANIMAL CONTROL: Unneutered Dog or Cat License: per year (Senior Citizen – No charge for one) $10. Neutered Dog or Cat License: per year (Senior Citizen – No charge for one) $5. Moving Bond Annual Permit: $2000.

Moving Bond Per Move: $500.

Moving Permit Per Move: $25.

NUISANCE VACANT BUILDING REGISTRATION: ANNUAL FEE: New: $1000. Renewal (Year 2): $2000. Renewal (Year 3 and later): – Annual increase thereafter of $1,000 added to previous year’s fee. FORECLOSURE MORTGAGEE: New : $500. Renewal (Year 2): $1000. Renewal (Year 3 and later): – Annual increase thereafter of $1,000 added to previous year’s fee.

Parks, Recreation and Forestry, Cemetery Services Fees, Charges, and Deposits: – See “2025 Fees & Charges” on file with the office of the Park, Recreation and Forestry Director.

Section 2.  Park Board Fee Schedule.  The Aberdeen City Council hereby approves and adopts the “2025 Fees & Charges” established by the Park and Recreation Board, and expressly incorporates such schedule herein.

Section 3.  Fees Effective Date.  The fees, fines, penalties, deposits, and charges set forth in Section 1 and Section 2 shall go into effect the date this ordinance becomes effective.  The city fees and related charges will be reviewed and may be adjusted at least annually.

Section 4.  Severability.  The provisions of this ordinance are severable.  If any provision of this ordinance or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application.
