Resolution to approve the Obligation of State and Local Fiscal Recovery Funds for the Water Reclamation Facility Improvements Phase 1 Project
WHEREAS, the City of Aberdeen, South Dakota (the “City”) received State and Local Fiscal Recovery Funds (“SLFRF”) under the American Rescue Plan Act (ARPA) to support necessary expenditures related to the COVID-19 pandemic and its economic impacts; and
WHEREAS, the City has identified a critical infrastructure project entitled “Water Reclamation Facility Improvements Phase 1” (the “Project”) that is eligible for funding under SLFRF, which will provide significant improvements to the City’s water Reclamation facilities; and
WHEREAS, the City has awarded a bid to PKG Contracting, Inc. of Fargo, North Dakota for the Project, as approved by the Aberdeen City Council on November 18, 2024; and
WHEREAS, in accordance with the rules and regulations set forth by the U.S. Department of the Treasury, SLFRF funds may only be used for costs that are incurred by December 31, 2024, and an obligation is considered incurred if an order is placed for property and services or if a contract or similar transaction requiring payment is entered into by December 31, 2024; and
WHEREAS, the City has committed a total of $5,110,164 in SLFRF funds for the Project, which includes the obligation for construction costs associated with the water Reclamation facility improvements, as outlined in the contract awarded to PKG Contracting, Inc.; and
WHEREAS, the City certifies that the obligation of the SLFRF funds for the Project was made prior to December 31, 2024, thereby meeting the statutory requirement that funds be obligated by that date.
NOW, THEREFORE, BE IT RESOLVED, that the City of Aberdeen has obligated the amount of $5,110,164 in SLFRF funds for the Water Reclamation Facility Improvements Phase 1 project, which is contracted to PKG Contracting, Inc. of Fargo, North Dakota, and that such obligation satisfies the requirements set forth under the U.S. Department of the Treasury’s guidelines, including the December 31, 2024 deadline for incurring obligations with respect to SLFRF funds.
BE IT FURTHER RESOLVED, that this resolution is adopted in compliance with the provisions of the American Rescue Plan Act, and the City affirms that the funds will be used in accordance with all applicable federal, state, and local laws and regulations.
