NOTICE OF PUBLIC HEARING TO ADOPT RULES

A public hearing will be held via Microsoft Teams, on May 18, 2026, at 2:00 pm (Central Time), to consider the adoption of proposed Administrative Rules of South Dakota num-bered

§§ 47:09:01:01; 47:09:02:01; 47:09:03:01; 47:09:03:02; 47:09:03:03; 47:09:03:04; 47:09:04:01; 47:09:04:02; 47:09:04:03; 47:09:04:04; 47:09:05:01; 47:09:05:02; 47:09:05:03; 47:09:06:01; 47:09:06:02; and 47:09:06:03.

The effect of the rules will be to establish the State Apprenticeship Agency (SAA) within the Department of Labor and Regulation, as authorized by Senate Bill 63 (2026). The rules define administrative duties, registration procedures, program standards, review require-ments, actions involving apprenticeship programs, reciprocity processes, and complaint procedures. They align South Dakota with federal apprenticeship requirements under 29 CFR Part 29 and allow the SAA to administer, register, oversee, and enforce Registered Apprenticeship Programs requirements at the state level.

The reason for adopting the proposed rules is to implement SB 63 2026 and the rules are required to obtain and maintain recognition as a state apprenticeship agency by U.S. De-partment of Labor (USDOL). Federal recognition will transfer registration and oversight authority from USDOL to the SAA.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear at the hearing, or mail or e-mail them to South Dakota Department of Labor and Regulation, 123 W. Missouri Ave, Pierre, SD 57501, or email at [email protected]. The deadline to submit any such written comments for consideration by this is ten days after the date of the public hearing and no later than May 28, 2026.

After the written comment period, the Department of Labor and Regulation will consider all written and oral comments it receives on the proposed rules. The Department of Labor and Regulation may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
