SOUTH DAKOTA PUBLIC UTILITIES COMMISSION

NOTICE OF PUBLIC HEARING TO ADOPT RULES

A public hearing will be held in Room 413 of the State Capitol Building, 500 E. Capitol Avenue, Pierre, South Dakota, on August 25, 2026 at 9:30 a.m., CT, following its regularly scheduled commission meeting to consider the amendment of the proposed rules 20:10:01:08.01, 20:10:01:10, 20:10:01:22.04, 20:10:01:22.07, 20:10:01:23, 20:10:01:24.02, 20:10:01:25, 20:10:01:41.01, 20:10:06:02, 20:10:06:03, 20:10:12:05.02, 20:10:12:13, 20:10:13:40, 20:10:16:01, 20:10:16:03, 20:10:17:13, 20:10:19:09, 20:10:20:08, 20:10:20:11, 20:10:24:04, 20:10:24:04.05, 20:10:30:01, 20:10:30:01.01, 20:10:30:02, 20:10:30:03, 20:10:30:04, 20:10:30:05, 20:10:30:06, 20:10:30:07, 20:10:30:08, 20:10:30:09, 20:10:30:10, 20:10:31:06, 20:10:32:03, 20:10:32:12, 20:10:33:27, 20:10:33:28, 20:10:37:18, 20:10:37:18.01.

The reason for adoption of the proposed rules is to repeal outdated, redundant, or preempted rules or portions of rules; clarify the process for filing of confidential information; update language in the general rules and gas and electric rules to clarify and simplify the requirements and update complaint requirements; clarify the procedure for release of a grain buyer bond and to require the provision of necessary information on voluntary credit sale contracts for grain transactions; update telecommunications provisions to align with current needs and technology; repeal unnecessary telecommunications filing requirements; and to update a pipeline safety notification requirement to ensure necessary information is provided to the commission.

The effect of the rules will be clarification of filing and complaint requirements; simplification of ARSD chapter 20:10 through removal of unnecessary or preempted requirements; removal of unnecessary filing burdens for telecommunications companies; updated gas and electric regulations that align with current practices; updated telecommunications rules that more closely reflect telecommunications technology; and to provide pipeline safety staff with necessary information in order to carry out statutory obligations.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person or telephonically at the hearing, or mail to the South Dakota Public Utilities Commission, State Capitol, 500 E. Capitol Avenue, Pierre, SD 57501 or by e-mail to PUC@state.sd.us. The deadline to submit any such written comments for consideration by the Commission is August 19, 2026.

After the written comment period, the Public Utilities Commission will consider all written and oral comments it receives on the proposed rules. The Public Utilities Commission may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
