NOTICE OF 2/17/26 PROCEEDINGS
The Spink County Board of Commissioners met at 8:30 AM on Tuesday, February 17, 2026, at the Spink County Courthouse. Present were Commissioners Dave Albrecht, Brian Johnson, Brett Knox, Kevin Siebrecht, and Suzanne Smith. Chairman Brian Johnson opened the meeting with the Pledge of Allegiance.
ADOPT AGENDA
Motion was made by Smith, seconded by Knox, to adopt the agenda. All members voted aye. Motion carried.
MINUTES APPROVED
Motion was made by Siebrecht, seconded by Albrecht, to approve the minutes of the February 3, 2026 Commission meeting. All members voted aye. Motion carried.
PUBLIC COMMENT
Jamie Fisk, resident, addressed a letter sent out by Northwestern Energy detailing a merger and their plans for growth. Commissioner Knox introduced the Doland High School government class students who will be observing today’s meeting, Gracelynn, Logan, Gavin and Kaiden and their teacher Mrs. Lemmer.
INTERGOVERNMENTAL CONTRACT
Motion was made by Smith, seconded by Knox, to approve the updated Intergovernmental Contract for the South Dakota Public Assurance Alliance. All members voted aye. Motion carried.
SHERIFF
Jenna Appel, Sheriff, gave an update of activities including vehicle repairs, and requested approval of maintenance contracts and a training request.
MAINTENANCE CONTRACTS
Motion was made by Siebrecht, seconded by Albrecht, to approve the service agreement between Spink County Sheriff Department and Voice Products, LLC, for the period of 3/25/26-3/24/27, in the amount of $6,435.10. All members voted aye. Motion carried.
Motion was made by Albrecht, seconded by Knox, to approve the GeoComm GIS map data maintenance and licensing contract for the term of 3/1/26-2/28/27, in the amount of $8,157.20. All members voted aye. Motion carried.
LEMPG AGREEMENT
Motion was made by Knox, seconded by Smith, to approve Exhibit B- Agreement Articles Certification of the 2025 Local Emergency Management Performance Grant. All members voted aye. Motion carried.
CASH TRANSFER
Motion was made by Knox, seconded by Siebrecht, to make a cash transfer of $69,345.26, restricted Opioid Settlement monies from 101-0-101, General Fund Cash to the newly prescribed special revenue fund 294-0-101, Opioid Settlement Fund. All members voted aye. Motion carried.
ABATEMENT APPLICATION
Motion was made by Albrecht, seconded by Smith, to approve the Applications for Abatement of Property Taxes for the property described as: Lease site shed, mobile home and carport in Leinen’s OL 1, Redfield City, Spink County, SD, abating: $1124.82 of 2025 taxes pay 2026 due to the mobile home being moved out of Spink County in 2024. All members voted aye. Motion carried.
NOTICE OF INTENT TO HOLD BINGO OR LOTTERY
Motion was made by Knox, seconded by Smith, to approve Spink County Daycare’s request to hold a raffle beginning March 16, 2026, to raise funds for the Spink County Daycare construction and start up costs. All members voted aye. Motion carried.
AMBULANCE
Clayton Blachford, Wildcat Rescue, gave an update of activities of Wildcat Rescue, a nonprofit 501 (C) 3 EMS organization serving northern Spink County, and made a funding request for 2026. Motion was made by Smith, seconded by Siebrecht, to approve the $8,000 funding request for 2026 for Wildcat Rescue. All members voted aye. Motion carried.
QUOTE
Theresa Hodges, Auditor, filed a quote received from Pauer Sound for microphones, speakers, digital mixer and installation, in the Commission Chambers. Additional quotes will be sought.
RESOLUTION AUTHORIZATION TO CONSTRUCT ELECTRIC TRANSMISSION AND DISTRIBUTION LINES ON THE PUBLIC HIGHWAYS OF SPINK COUNTY (26-13)
WHEREAS, East River Electric Power Cooperative, Inc., of Madison, South Dakota, on the 20th day of January, 2026, filed with the County Auditor of Spink County, South Dakota, its duly verified Petition for the purpose of obtaining and acquiring one franchise for both its existing transmission lines and system and the planned extension and future expansion thereof, from Spink County, South Dakota, by and through its County Commissioners, for the right to maintain its existing and future system and to erect and maintain poles and wires for the purpose of transmitting and distributing electricity for lighting, heating and power purposes, in, along, and over the public highways of Spink County, South Dakota, for rural electrification throughout said County and State for a period of twenty years;
WHEREAS, said application was heard and considered by the members of the Board of County Commissioners of said County of Spink, in South Dakota, on the 17th day February 2026, at the hour of 9:15 o’clock am., in the Commissioners’ Room, in the Courthouse, in the City of Redfield, Spink County, South Dakota, due notice of said hearing having been given by mail as provided by law to all persons, firms or corporations owning or operating transmission, telegraph or telephone lines on or along any part of the highways of said County;
WHEREAS, no person, firm or corporation having appeared in opposition to the granting of such application, and it appearing to the satisfaction of the Board of County Commissioners of said County that the request contained in said Petition should be granted;
THEREFORE, BE IT RESOLVED, by the Spink County Board of Commissioners that the right to construct, maintain and operate poles and wires, both for its existing transmission lines and system, and also for its future extension and expansion, for the purpose of transmitting and distributing electricity for lighting, heating and power purposes, over, upon, along and across the public highways within
Spink County, South Dakota, for rural electrification, on a county-wide basis, for a period of twenty (20) years from and after the date and passage hereof, be, and it hereby is, granted to said East River Electric Power Cooperative, Inc., of Madison, South Dakota, subject to the terms and conditions of Chapter 31-26 of the South Dakota Codified Laws (1984 Revisions).
Motion by Knox, seconded by Siebrecht, to adopt the above resolution. All members voted aye. Motion carried.

FIRST READING OF ORDINANCES
At 9:20 AM, time given by public notice, the first reading of Ordinance Title 17.02 Definitions and Ordinance Title 17.30 Data Centers was conducted. No person or their representative testified for or against the ordinance. The second reading and adoption will be held on March 3, 2026 at 9:20 AM.
ANNUAL REPORT
Theresa Hodges, Auditor, reviewed the Annual Report for fiscal year ending 12/31/25, the report has been filed with the SD Department of Legislative Audit and published in the legal newspapers.
ENERGY
Tom Glanzer, Brian Kemnitz, Mike Baumgarn, and Jeff Decker, Northwestern Energy, discussed the merger with Black Hills Corp., generation plant replacements, potential energy loads from data centers, and rates.
PLANNING & ZONING BOARD
At 10:05 AM a motion was made by Smith, seconded by Knox, to recess as a Board of Commissioners and convene as the Planning & Zoning Board. All members voted aye. Motion carried.
The Board of County Commissioners reconvened at 10:17 AM after having adjourned as the Planning & Zoning Board.
HIGHWAY SUPERINTENDENT
Jeff Haessig, Highway Superintendent, gave an update of activities and spring load limits being posted.
