NOTICE OF 3.17.26 PROCEEDINGS
The Spink County Board of Commissioners met at 8:30 AM on Tuesday, March 17, 2026, at the Spink County Courthouse. Present were Commissioners Dave Albrecht, Brian Johnson, Brett Knox, Kevin Siebrecht, and Suzanne Smith. Chairman Brian Johnson opened the meeting with the Pledge of Allegiance.
ADOPT AGENDA
Motion was made by Smith, seconded by Knox, to adopt the agenda. All members voted aye. Motion carried.
MINUTES APPROVED
Motion was made by Siebrecht, seconded by Knox, to approve the minutes of the March 3, 2026 Commission meeting. All members voted aye. Motion carried.

PUBLIC COMMENT
No one was present.
SHERIFF
Jenna Appel, Sheriff, reviewed current prisoner confinement costs and expenditures for the 911 grant exceeding the approved amount, requested approval to apply for grants, and filed training requests.
CONFINEMENT COSTS
Motion was made by Knox, seconded by Siebrecht, to set the confinement cost rate for all Spink County prisoners at the daily contracted rate of the holding facility for the entire post sentence confinement, effective March 17, 2026. All members voted aye. Motion carried.
GRANT APPLICATION
Motion was made by Albrecht, seconded by Smith, to approve applying for Homeland Security grant for the purchase of an updated camera server and security cameras for the Courthouse and Law Enforcement Center, at an approximate cost of $26,900, with 100% grant reimbursement; and to apply for a second Homeland Security grant for the purchase of two Motorola APX 4500 mobile radios, at approximate cost of $9,809.84, with 100% grant reimbursement. All members voted aye. Motion carried.
FRANCHISE AGREEMENT
Robert Gehm, NorthWestern Energy, reviewed NorthWestern’s application for County natural gas franchise renewal.
RESOLUTION AUTHORIZATION TO CONSTRUCT, LAY, MAINTAIN AND OPTERATE NATURAL GAS PIPELINES AND MAINS ALONG THE PUBLIC HIGHWAYS OF SPINK COUNTY (26-14)
WHEREAS, NorthWestern Energy Public Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy (Northwestern), has filed an application with the Spink County Board of Commissioners pursuant to SDCL 7-8-23 on February 19, 2026, seeking the right to construct, lay, maintain and operate natural gas pipelines and mains along the county highways located in Spink County, South Dakota.
WHEREAS, the Spink County Board of Commissioners has the jurisdiction and authority to grant the application of NorthWestern as set forth in paragraph I above, subject to such conditions as it may desire to impose.
THEREFORE, BE IT RESOLVED, by the Spink County Board of Commissioners as follows:
- That the application of Northwestern dated February 19, 2026, for permission to construct, lay, maintain and operate natural gas pipelines and mains on and along Spink County Roads is granted subject to the conditions set forth herein.
- That this grant is for a period of twenty (20) years from and after March 17, 2026, or as may be extended by the Spink County Board of Commissioners in writing at a subsequent date.
- That as consideration for this grant, Northwestern agrees to indemnify and hold harmless Spink County, its officers and employees from any and all liability, damages, claims, demands or otherwise, whether the same is based on contract or otherwise in law or in equity associated with the design, construction, installation, laying operating, inspecting, repairing, maintaining, replacing, and removing pipes, mains, valves, and all other devices used in connection with the operation of its natural gas pipeline located pursuant to this grant, except such liability, damages, claims or demands which arise as a result of the negligence of the county, its officers, employees or agents.
- That as additional consideration for this grant, NorthWestern agrees to restore, at its expense, the affected areas in as good condition as before said work was commenced and replace any structures affected, i.e. culverts and signs; and if the county road should be rebuilt or construction and maintenance of the county road requires the removal or relocation of the pipeline, it shall be solely at the expense of NorthWestern.
- That the rights and conditions by this grant shall be binding upon the successors and assigns of NorthWestern.
- This grant shall further be subject to all rules and regulations as are prescribed by the State of South Dakota relating to the construction, operation and maintenance of gas pipelines and mains.
- That this grant shall not be effective until execution of the acceptance of the conditions set forth below by NorthWestern.
Motion by Smith, seconded by Knox, to adopt the above resolution. All members voted aye. Motion carried.

PERSONNEL
Motion was made by Smith, seconded by Knox, to grant the same leave as given by the State of South Dakota to employees and to close Spink County offices all day on Friday, April 3rd and Monday, April 6th, 2026, with the following policy: each full-time employee will be compensated for eight hours regular pay on April 3rd and eight hours regular pay on April 6th. If an employee is required to work a full shift, eight hours will be added to their vacation record for April 3rd and/or eight hours will be added to their vacation record for April 6th – under no circumstances will premium pay be paid for those hours. All members voted aye. Motion carried.
BID ACCEPTED
Motion was made by Smith, seconded by Siebrecht, to accept Beadle County’s low bid from TrueNorth Steel, Huron, SD, for corrugated metal culverts, effective 1/1/26 through 12/31/26. All members voted aye. Motion carried. Bid specs, minutes, affidavit of publication and award letter are on file in the offices of the Spink County Highway Superintendent and the Spink County Auditor.

Motion was made by Albrecht, seconded by Siebrecht, to approve Dakota Air Spray’s Permit to Land Aircraft on Spink County Highways for 2026. All members present voted aye. Motion carried. Better communication with landowners on parking trucks on private land and with the Highway Superintendent informing of days the permit will be utilized will be required of the company.

At 9:29 AM a motion was made by Smith, seconded by Knox, to enter into executive session to discuss personnel, with Theresa Hodges, Auditor, present. All members voted aye. Motion carried. Chairman Brian Johnson declared the Board out of executive session at 9:48 AM, with the following action taken: Motion was made by Smith, seconded by Knox, to approve an employee’s FMLA leave request. All members voted aye. Motion carried.
