NOTICE AND ORDER FOR HEARING
A petition has been filed by Jason John Peterson, the grandson of Mary Josephine Walker, requesting the appointment of Jason John Peterson as guardian of the person of Mary Josephine Walker and conservator of the estate of Mary Josephine Walker. The petition alleges that Mary Josephine Walker is unable to care for her physical and emotional needs. She has Alzheimer’s and Dementia. She is diabetic and has brain damage. She lacks the mental capacity to understand and make informed decisions regarding financial matters, including the ability to sign financial documents or manage investment accounts. A copy of the petition is attached and you are referred to it for further details. If a guardian and conservator are appointed, the guardian and conservator may be given full or partial control of the care and custody of Mary Josephine Walker’s person and estate and may have the right to regulate certain or all Mary Josephine Walker’s activities. The petition will be heard before the Honorable Judge Sommers in the courtroom at the Brown County Courthouse in Aberdeen, South Dakota, on the 7th day of July, 2026 at 9:00 o’clock a.m.
Mary Josephine Walker is not required to attend this hearing.
The person alleged to need protection has the right to attend this hearing, to oppose the appointment of a guardian and conservator, to demand a jury trial, to present evidence, to compel the attendance of witnesses, and to confront and cross examine all witnesses. The person alleged to need protection has the right to be represented by an attorney of her own choice or to an attorney appointed to the court upon her request.
An attorney has not been appointed to represent the person alleged to need protection.
Other persons interested in these proceedings may apply for perm1ss1on to participate at the hearing. Participation will be allowed if it appears that it is in the best interest of the person alleged to need protection.
